We were quoted $65 by ************************* owner of JW Construction in Sept 2021 to construct **** detached garage with a standing attic and mancave room on the backhalf of the building, but we did not get what we ask, were quoted and paid for. We discussed with ****** in great detail when we hited him that we wanted the option to eventually turn the attic into an extra sleeping area for family/guest, but we ended up with literally a crawl space that we can only stand on the stairs and reach so far or crawl into.My husband and I noticed the the roof frame looked too low for a walk in attic the night the framing was just about completed. We called ****** the next day and he stop by the house to discuss the problem with attic, and his only solution after admitting his error was to "finish it out" over the mancave area as well; which meant putting floor boards down. My husband and I both just figured ****** would do right by us because he made a major error and made it know to us that he was a ********* as well, so we thought he would adjust the price at the end but he didn't willingly.****** reluctantly agreed to reduce $2500 from the $13,300 end balance we owed, after telling us "if we need the money go ahead and keep it". We had suggested to him (since he offered nothing or a resolution) to deduct $5000 as a low end resolution for not giving us what we wanted or he quoted us; we had already paid him $50k . If we were to hire someone else to redo the top half of the building to get the storage/sleeping room in the attic it would cost us well over the $5000 we had ask ****** to deduct from remaining balance.

I am rejecting this response because: ****** is not being truthful; his own workers know the truth because they where on on site, and I have pictures of him trying to figure out the out the problem withthe roof. I'm willing to submit a sworn statement before God and a court of law.

I am rejecting this response because:
I have photos and text messages of the majority if not all of our conversations with ****** or his associates concerning the major issues on our project. The reason I started putting things in writing was due to all the inconsistency in conversation, scheduling were told or saw. And there's a lot so I will either take a screen shot of them or forward them to you in a email.I'm not surprised that ****** isn't being completely honest about the errors that occurred outside of the scope of the contract.

      Complaint: 16776228

I am rejecting this response because:

      Good Morning ******,

Our reason for the rejection is that ****** says one thing and does something else, and because of his inconsistency practices it caused numerous errors and problems that ultimately "we" the customer pays for.

From the very beginning ******** started with a lack of transparency and misleading statements; like when he informed us that he had his own team and in fact with the exception of the three framers every job was done by subcontractors.

We ask if he had done a brick detached garage before and he stated he had, however our project failed the city inspection due to two smaill elbow brackets were not installed.

The door and windows were suppose to look like our current windows and french doors (which has 3 across & 5 down individual panes in bronze) ****** informed us he had ordered them to match; however the door nor the windows when I saw his team of framers preparing to install them matched as we previously agreed upon.

We discussed on site with ****** on showed him the placement of the beams and mentioned we did not want them blocking the two window view; however yet again while out walking my dog I noticed the guys had drilled holes in the concrete and both beams were indeed blocking the windows, so I stop them and show them where Jarret, my husband and I had just talked about the placement like two days prior if that long.

I sent pictures to the team for door opening directions (right & left ) and  black metal placements on the beams were to face the yard (to match our current three beams on the patio), and yet again walking by the project I had to tell the guys the door was opening in the wrong direction,  the black metal brackets were facing the wrong direction, and the exterior door wasn't framed correctly because the door didn't open all the.

Due to the huge scheduling problems/issues and often due to  incomplete work or sub-par work all of the subcontractors had to turn to the project multiple times throughout the entire project.

For instance the garage door installation, tape & float of the walls and painters had to do their work with no electricity which ultimately lead to them all having to return to complete or redo some work.

During our evening walk through the building; something my husband and I did daily because there was no on site forman to check the progress or work of the subcontractors; we noticed the tape & float lines were very visible through the freshly painted walls, so we had to point that out to ****** and the entire building had to be redone by the tape & float guys and the walls being repainted.

It took 5 days for the brick guys to complete bricking a 12×35 building which was ridiculous. I have pictures of a worker just sitting on the rafters on his cellphone on two different occasions.

We have a 8ft garage door with an 8ft ceiling, so the garage door installer had to turn a part upside down in order for the track to fit the low ceiling, and we pray that quick fix doesn't cause any problems in the long run.

I previously stated in my complaint about the attic issues not being a walk in, but instead a crawl space and I know it's not detailed enough on the contract because ****** stated we would discuss all the details when the time comes, but that never happened.

However ****** knew exactly what we ask for and we discussed it with him and prior to start if the job and on that particular day I stopped his framers call ****** to come e to the house because there was a problemwith the ceiling being too low.

The picture I sent you was with his framers holding a beam lowering and raising it to show ****** how high the roof would be. At that point is when ****** admitted his error and stated that "it was on him" and that the drawing didn't reflect the higher roof which meant at that point there was nothing we could do because the slab, framing was done.

Us being naive and perhaps too trusting just figured ****** would adjust the final price to reflect such a huge error, because after all we had established a respectful Christian relationship despite all of the delays, errors, and false promises.

The below is a text that I sent ****** in Dec, because there were several days

      Regards,

      ******** ****

      Hello Mrs. ******,

I hope you and Mr. *** are doing well. I understand your frustration about the project as a whole. Doing it over again, there would have deft been some things I would have done differently from an owners standpoint.

That being said, you have a very beautiful, finished product that I gave you and Mr. ***. I know that y’all will enjoy it for years and years to come.

      Very Best,
      ******

      Complaint: ********

I am rejecting this response because: Yes we do have a beautiful project but we don't have what we we're quoted and paid for; which was a walk in attic that we could convert into a bedroom later.

****** you know we discussed that option with you in person and on the day we brought it to you and your teams attention you realized the major problem.

      Regards,
