Eileen and her husband, ******, failed to deliver our wedding photos and video.Pursuant to our ************* Proposal dated 1/19/22, Photography by Eileen promised to provide its ************************************ Package, which included: (i) edited pictures on a USB drive with no[] limit on the number of pictures; (ii) a Full Video of your Ceremony; (iii) a Highlight Movie (any length you want up to 30 minutes); and (iv) a Print Package. These items were to be provided approx. 4 to 5 weeks after the Event. The Proposal also included One Primary Photographer[,] One Videographer and One Assistant Photographer (for Getting Ready and B Roll Photos.) A professional photographer with similar skills to Eileen was to be provided should an emergency prevent Eileen from serving as photographer. In May 2022, we informed Eileen that our wedding date had been postponed to October 15. Eileen stated that the Company had another event scheduled but could handle both. We agreed to two, not three, people.Only one person (******) appeared at our wedding. The few photos and photo editing we received were very poor. None of the family photos were taken at full length. When we asked them to provide raw images (CR2 files) so that we could use a professional photo editor, ****** informed us that they had already cleared the ** card of photos, with several hundred once-in-a-lifetime photos. In late December, we sent them a letter regarding their many breaches of the contract. In response, they claimed that we breached the contract by moving our wedding date, so the contract no longer applied. But the contract states, if the event needs to be postponed for a later date, there will be no additional charge to reschedule, and full credit will be applied toward a new date, which implies that the contract is still valid. They claimed offering ****** as a one-man-show was a generous solution." Furthermore, we have not received any videos although we paid in full.Business response

We would like to provide our truthful statements to counter *** many falsehoods and distortions of *** truth in *** allegations made by ******************************* (formerly *********************) against our company and personally. We contend that ************************* is in fact *** one who had breached our contractual proposal by changing *** date of her Wedding without informing us ahead of time. We can not be held responsible providing our services for a new date o***r than *** one we had contracted for once *** new date established without our awareness and to see if we were in fact available.
For *** purpose of clarifying *** allegations made by ************************* in this dispute, I will be abbreviating her statements with *** heading: T H. I will also abbreviate our responses to those statements as: PbE (ie. Eileen and *********************************.) I thank you for your attention to this matter and hope to resolve this is*** quickly, peacefully and fairly.
T H - Accusation 1:
Eileen and her husband, ******, failed to deliver our wedding photos and video.
Pursuant to our ************* Proposal dated 1/19/22, Photography by Eileen promised to provide its Photography & Videography Package, which included: (i) edited pictures on a USB drive with no[] limit on *** number of pictures; (ii) a Full Video of your Ceremony; (iii) a Highlight Movie (any length you want up to 30 minutes); and (iv) a Print Package. These items were to be provided approx. 4 to 5 weeks after *** Event.
PbE - Counter 1:
We had delivered both edited photography and raw photography in a timely manner to ************************* after her Wedding day. We were manipulated by ************************* to deliver *** raw jpeg images that were taken at her Wedding day as she repeatedly threaten to *** us utilizing *** services of her new fa***r in law as her and her husbands attorney. It is stated on page 3 in our proposal that we do not provide raw images or video, however we had to make a rare exception due to *** threats.
************************* claims that we had promised her a Photography and Videography Package (and remarked on *** items that included.) This is not true. The truth is that in our proposal dated Jan. 19, 2022 we had offered her and her fianc, *********************************** two options for our services. The first one was for a photography only package and *** second was for a photography and videography package. Each package was priced separately. They had chosen *** photography only package, which ***y had paid *** exact amount for. We were also very generous to offer ***m a no charge engagement portrait session if ***y paid in full upfront, which ***y took advantage of. The engagement portrait session was completed and ***y received all of ***ir edited pictures to ***ir satisfaction. They had also acknowledged that *** reason why ***y did not choose *** photography and videography package (that we had offered ***m at a tremendously low cost) was that ***y simply werent very interested in having video for ***ir Wedding day. They were only due for *** items that were listed within *** photography only package which ***y had paid for.
Fur***rmore, and very importantly, *** proposal was for ***ir Wedding day of Sept. 24, 2022. I would like to stress *** date of Sept. 24th, that had been agreed upon in our proposal as it is pivotal towards *** accuracy and truthfulness of many of *** claims that have been made by ************************* in this dispute.
T H - Accusation 2:
The Proposal also included One Primary Photographer[,] One Videographer and One Assistant Photographer (for Getting Ready and B Roll Photos.)

As stated before, ***se items do not apply to *** proposal, since ***y did not choose or pay for *** photography and videography option.
T H - Accusation 3:

PbE - Counter 3:
Mr. and ************************* did not inform of us of *** change of date of ***ir Wedding until mid July. We had previously booked a Wedding with ano***r couple on *** (who had also paid us) on *** same date as *** Hirschmanns new date of Oct. 15, 2022. When we booked with this o***r couple, we had no knowledge that *** Hirschmanns had changed ***ir date. ************************* has stated in many negative reviews towards us that we had double booked her date. Again, this is not true. Also, *** statement that we agreed to provide ***m with two people is not true. We had all agreed that ****** would handle *** photography and have a separate camera set up on a tripod on wheels to video some parts of ***ir event. It is our contention that we were kind enough to still service ***ir Wedding day even under *** circumstances, while having to pay a videographer to work with Eileen on *** Wedding that we had previously booked (and not double booked!)

We had provided ***m with all of *** Raw Jpegs that we taken, even though this is not our policy. We do not edit CR2 files, we edit *** Raw Jpegs. Our work has been published in many magazines utilizing our edited pictures from *** Raw Jpegs, including several times in: DFW *********** ************** and D *************************************** 5:

Fur***rmore, we have not received any videos although we paid in full.PbE - Counter 5:
We will work with our customers if ***y need to change *** date of ***ir event when we ***y communicate with us about *** date to make sure that we are available. If ***ir claim was true, anyone of our customers or even many of our customers could just change *** date of ***ir event and not tell us and still expect us to be responsible to service ***ir new date. No professional photographer or videographer (including us) could remain in business if this nonsense argument is applied.In conclusion, we have many many attempts to try to appease *** Hirschmanns, including trying to negotiate a payment plan to repay ***m in full over a years time. Our agreement has been based on *** fact that would not publish negative reviews on social media (and etc.) or with *** BBB or attempt to take legal action against us. Our attempt to appease *** Hirschmanns was not an admission of fault, but instead to not have ***m harm our business or us personally, even though ***y continually are not truthful in ***ir statements and ***ir story. They have spend *** last few weeks finding any social media website to tarnish our good name.

Eileen and her husband Howie were supposed to photograph together on my wedding date 12/10/2021. Eileen canceled the morning of saying she got into an accident and has multiple broken ribs.. However Howie did show up. I have yet to receive photos and now they will not answer my messages. I also have in writing that they will give me up to a $500 refund.Business response

Business Response /* (1000, 10, 2022/02/04) */ I did have an accident which became a medical emergency that unfortunately left me unable to shoot ******** & ******'s Wedding. My husband, Howard handled the responsibilities of both the Photography and Videography. Since we use both stationary and mobile videography equipment, he was able to perform all the services that they were promised. We have already sent the customer approx. 150 edited photos and their completed videos. We have also explained that due to my accident we were a little behind schedule, however we will have the rest of their edited photos completed within a few days. Additionally, our agreement was to refund the $ 500.00 to ******** & **** over a period of time and not in one lump sum immediately. I thank you in advance for your time and consideration and hope that we are able to work with ******** & ****** so we can move forward with a mutually peaceful and satisfactory matter, as well as to close this complaint.
