Around August 31st I got a brand new scooter from ****** Motorsports. On August 6th 2024 I received the scooter from the very beginning off the back of the truck. It came with a chipped rim and a broken or bent sensor plate. From the very beginning I put in a claim about those parts and they were approved and to this day I still haven't received them. On top of that I have bigger major issues than that. I was driving down the road and the scooter randomly just shut off. With that said, this is me only owning the scooter for 2 months .To make a long story short, I brought it to a professional mechanic and he called me with bad News saying it's a broken head gasket. Here is the exact text message he sent to me and wanted me to write to the company.i called new phone number is ************. was told customer must call to put in claim and have original purchase invoice or order number. Tell them a Genuine / Kymco scooter dealer looked at your scooter and feels it has defective head gasket or defective head due to the tremendous amount of oil being pumped into the air filter housing. it was also leaking oil from cylinder head cover gasket which we already did replace this. and tell them so much oil in air filtet box totally destroyed the *** filter element. **** I have been having a very hard time speaking to these people. There is no way to contact them on the phone. They want you to do everything by email. Claims are done by email. It's horrible. I've never dealt with such a poor performance company that neflects their customer once they get your hard-earned money. It's horrible. If I would have known this is how they treat their customers prior to buying this I would have never bought this from them. It's been nothing but a excruciating experience. They are trying to blame me without even seeing the scooter or having proof that I put too much gas in the scooter that I overfilled it. Which is total BS without them having proof. They're trying to blame me without even seeing the scooter or having any proof. They sent me an email saying that there was gas in those breathing tubes and I overfilled the gas tank with gas which is a complete lie!! It was oil in the breathing tubes. I believe I sent you guys the video I sent them. It's only about 9 to 10 seconds. Scooter is at a professional mechanic shop, after the guy looked over my bike he came back with a broken head gasket. Here's the exact text message he sent me........

The video I attach is from **** powersports where the oil is pouring out the air filter box. Like I said I wouldn't be doing this. If I knew I was in the wrong. I wouldn't waste my valuable time and energy. I have a million other things I could be doing then complaining about this neglectful unprofessional company. Thank you guys very much. In that picture you can see that these people didn't even add bolts to the exhaust. When I first got the bike all I had to do was put the front handlebars together The front wheel then the rest is all cosmetic. The engine and all that they put together. It just goes to show that I've been having headaches with these people from the very beginning starting with the chipped rim, the broken sensor plate which therefore wouldn't give me my miles per hour speed. That was even before I even got to ride the bike. That was before it even touched even came off the truck. Just fed up with these people how unprofessional and neglect fold they are. The head gasket issue started September 25th. The name of the scooter is a vitacci tank 200 efi. Even the mechanic where my scooter is at. He is saying even bikes that are 10 years old. He has never seen a blown head gasket like this squirt so much oil out of something. He's basically lost for words. As I sent you the previous message that was his exact words he wrote to me. He was trying to call the company on my behalf but they only have a phone number for sales processing. None for complaints. That is all done over email which is a pain in the **** and hard to get in contact with them through that way. Do you guys need any other information? Hello,
The customer currently has an open claim with us and we are communication with him to get this resolved. Last email that our mechanic sent to customer he is asking him for a diagnostic receipt from his repair shop. We are currently waiting on that from him. We are hoping to get this issue resolved as soon as possible.

This is beyond frustrating with these people. I do not trust them to do any work on my engine. Clearly they didn't read the estimate bill because it's the head gasket issue, not a engine issue. I'm taking the word from professional mechanics. He's the one that's been looking at the bike. These people are just coming up with bogus answers without even seeing the issue with their own eyes. I've done everything they've ever asked from day one. Like I said in the previous message this bike had issues from the beginning, the chip, the rim and the bent sensor plate which therefore provides your speedometer. I don't have access to that. These parts have been approved for months and I still haven't even gotten that. Now this is happening. I shouldn't have any engine issues after 2 months. Only thing I've done was put gas in it and not to the very very top overfilling it like they were first trying to claim. I can provide you emails where they're coming up with random excuses. They tried to say I overfilled it with gas and now they're trying to say oh it's an engine issue and if we find out it's your fault you're going to have to pay for shipping and all this and I'm beyond frustrated. Please can you help me? Why can't they just pay for the cost of the repair? They want me to jump through hoops I've and I'm done jumping. Again, all I was doing was riding the bike and it randomly turned off. That's all that's happened that led to all this.Initial Complaint

ordered 50cc motor-bike from company, had numerous issues until vehicle ceased working gradually then completely. brought each complaint to company with many "guess diagnostics" that did not work, documented by e-mail exchange. Company shipped bike with company that left created vehicle 3 blocks from delivery address with no notice until afterwards, which resulted in court appearance to explain and show shipping documents which was reported. Told these vehicles regularly have issues with fuel and/or battery which was not disclosed upfront but obviously well known to company which resulted in guess diagnostics that wasted money and resulted in no further usage. Finally given lists of 'in network' repair shops none of which are within 25 miles of my home nor was I provided with any information on transportation of vehicle as it is knowingly to the company not working. Video of vehicle requested proving no unexpected usage wear or tear or milage factored into this need for repair and indicates both traditional and legal definitions of a "lemon" resulting in the need for better customer service, ability to ship vehicle back for inspection and/or replacement, refund, or some combination of aforementioned to remedy situation.Business response

Customer contacted us for technical support which we were able to assist him with. We sent him out a part and sent him videos to help him trouble shoot on his end. I am rejecting this response because: part sent was not the issue, previous guesses resulted in unnecessary out of pocket costs, locations provided for repairs were all over 20 miles away and as vehicle does not work would result in additional costs plus repair which would surpass half the value of the vehicle and at this point as 4 different fixes were offered resulting in the same lack of use this qualifies under **** consumer protection act as 'totaled or lemon.' I am not asking for any special treatment not trying to wrong the company in anyway. This complaint is made in good faith and the lack of use is causing other difficulties in my day to day life which need resolution as soon as possible. Thank youBusiness response

We have assisted the customer by trouble shooting with him and sending him parts. His next step is to have his scooter taken to a professional mechanic so that they can take a look at his scooter. We have sent him a list of shops that can take a look at his scooter. The list will also be good for his 500 ODO maintenance & services. We strongly encourage the customer to reach out to one of these shops to set it.Customer response

my moped scooter came in a crate and the item was damaged having a broken speedometer and cap behind it. This is not legal to drive due to the fact that the speedometer does not work and the cap is coming off, so I contacted them regarding this with pictures and proof right away, and they have told me that they will ship out my parts, so the parts I was supposed to receive was the cap the speedometer and I guess the *** thats connected to it so three parts completely I only received the plastic cap and I received nothing else so the fact that I am not able to drive this with this broken speedometer is not OK. *** contacted them about 30 times and ive sent them emails constantly with proof of screenshots that they have said that they will send it out and every time I contacted them they told me to wait so far its July 1 and I contacted them May 24 and I have not received anything. They are extremely disrespectful and not following the warranty process that was paid for and provided with purchase. Upon the screenshots that I will provide it says that they will send out those parts and they will get back to me with more information and I have yet to receive any tracking information and information about the parts or anything. They are very rude and will not respond back to any claims and keep telling me to wait once again theyve sent me a broken moped and will not acknowledge it.Business response

I had purchased 2 motor bikes. I did not receive updates or tracking. I did research online and found hundreds of complaints. Knowing this and knowing I didnt receive any shipment updates I requested to cancel. They proceeded with cancellation but charged me almost 50% to cancel. They did not inform me I would be paying almost a thousand dollars to cancel my order. Had knowing that I would not be canceling, rather just receive the goods.Business response

I ordered this 4 ******* for my sons birthday. Upon getting it out of the box & getting it assembled it wouldnt start. The starter chain was sent off the starter. So I contacted the company they sent a video on how to put it on. My son rode it for not even *********************************************************************** the side of it pouring oil out. I contacted the company they waited 15 days to get back to me after telling me it needed 48 Business hours. I called and complained, emailed and nothing worked. I even bought the warranty but this is something that shouldnt have happened right out of the box. They were super rude to me. They said they were sending me the parts to fix it as a courtesy over 2 weeks ago and I have yet to receive them they wont follow up with me. I have been almost 2 months owning this machine and only had used it for 20 minutes. Has been sitting sense. Ive called multiple times emailed multiple times sent pictures everything in my power to do. I am a single mom of 3 kids and this was a birthday gift to one of them. I look terrible because its broken now he can just look at it. Hes devastated everyday he asks me when the parts will be here. This machine is junk, the company is terrible.Business response

Based on the information the customer provided the part they are requesting is Not Covered under our limited parts warranty however we are going ahead and getting the parts for them a courtesy. We have let the customer know via Email that his parts have been ordered. We let him know that these parts are usually not stocked because it is rare that these parts get damaged. These parts have been ordered as a onetime courtesy for our customer. We are trying our hardest to get these parts for him and we will let him know when they are on their way to him. If he needs anything else he can reach out to us.

I am rejecting this response because: The machine was broken out of the box and the company was aware of it and just kept sending me how to videos on fixing it. It ruined my kids birthday because he got to ride it for 20 minutes then it died. That was 4/13 and I still have not gotten the parts. I would like some compensation for this headache and upset that this has caused my son. Just to sit and look at his birthday present that was over $800 so he didnt get any other present from me being a single mom. This is straight up ridiculous. My plan was to buy another machine in October for my other sons birthday but after this experience I will never buy from this company again. Im going to be reaching out to a lawyer I have consulted with one already and they are more then willing to go forward with the case.Business response

I am rejecting this response because: I have emailed the company over and over again with no response. This machine has now been broken since March when I received it. Now the company is taking their sweet time conveniently my warranty is going to be voided by the time that they decide to give me the parts they have not reached back out to me and I have emailed them repeatedly and they are just continued to ignore me. This is complete ********. Im going to just contact a lawyer to move forward with this case. My son is very upset by this as it was his birthday present and they sent it broken. Ive waited almost 2 months for these parts!! This is ********. I want to be reimbursed for this machine, they can come pick it up and I will go buy him a quality one from somewhere else because obviously this company is just a bunch of scammer artists.Customer response

They have not been in contact with me since filling the claim and still have not received the parts they said they sent as a replacement to fix the machine. Getting really frustrated with this company and this entire process I havent heard from the company at all other then telling me the part was on back order that was in April!Business response

I ordered a 4 ******* on 11.24.23, estimated delivery was 12.08.23-12.13.23. The item did not arrive, when I went to call to get updated information,I could not get one person on the phone. When *** answered he would not give me any information because my sons name was on the order. I informed yes because it was a Christmas present but I could provide all the information needed. He refused to speak with me, my child is a minor. I then called back the next day and spoke to a very nice lady whom said she updated my account so that someone would speak with me and informed me she would reach out to the carrier. I never heard back from anyone and sent several texts and calls, in which I received a voicemail saying my item would be here by Christmas but no other information. For this item to arrive someone needs to be present to sign for the package. I continued for follow and requested the item be expedited and the shipping be refunded. The company refused to do so and then cancelled my order without my consent.Business response

Customers ATV was running a little late and customer was requesting a complete refund on shipping with expedited shipping. That was something we could not provide for our customer. I purchased two 36 Apollo dirt bikes. One of them the gas tank was leaking gas when I received it. The other bike the air filter was missing a air box cover. They are both brand new with 30-day warranty. I filed a warranty claim immediately and have been following up for 2 months straight once a week. They seem to be annoyed with my follow-up, which I do once a week which I feel is minimal since I did buy two brand new bikes expecting them to be fully functioning. At this point they are no longer accepting my emails. I've had to call them for the last week to get a response. The manager is now telling me the only way to request updates for my parts is through emails which I stated my emails are not being accepted by them. The manager said it didn't matter it needed to be handled through email only knowing my emails don't go through. I then stated "I can't email you and I do not like calling you and if I can please talk to your manager" before knowing he was the manager. He then stated he is the manager and that I needed to email him with my problem(mocking). I feel he was mocking me and I stated at this point I have no choice but to make a bad review since you guys are no longer willing to help me get my defective parts replaced. He then stated "are you threatening me" and I told him no. That is pretty ridiculous for the manager to feel threatened over an issue that should have resolved easily. So my issue is my two brand new dirt bikes are missing/defective parts and they do not want to make it right with warranty claim.Initial Complaint

I ordered a dirtbike for my 11 year old son. The bike arrived by truck on October 2nd. The entire box (about a good 4-5 foots area), was totally open and ripped apart! Also, the metal casing which surrounding the dirtbike was bent. I refused delivery, as most 100% people would do based on condition! I compare it to Amazon deliveries you see at door and their boxes arent ripped opened. I was unable to assess the dirtbike as I purchased it unassembled, which is an option due to a $99 additional fee if they put together. Now this company, whom I finance through a 3rd party named affirm is threatening 20% restocking fee and/or picking the dirtbike up at their terminal. This company doesnt have a review rating of a ONE for no reason! I wish to report them as a company taking advantage of people. This isnt fair what so everBusiness response

We received information from the carrier that the bike was turned away from the customer due to it being too small for his son. Not because the bike was damaged as he is stating. The bike was undamaged and we received confirmation from the carrier. We list on our website the technical specs of the item so that the customer can determine if it is a good size for their child. Purchased on 6/19/2023 for $2,029.60. The warranty states that if there are manufacturer defects, it is covered. The 4wheeler showed up not working correctly and now it will Not start period. It has had only 1 hour drive time. Ive emailed and called Killer Motor Sports asking for help and to back their warranty. Ive provided all the documents theyve asked for to support the warranty claim. Once I provided the documents containing the proof of issues from another 4wheeler service company, I have not heard back for almost 2 weeks. The 4wheeler was a birthday present for my son who has been unable to use it.Business response

We have been in communications with the customer via email and over the phone. We have approved her claim and we are sending her a new stator so that she can replace on her new ATV. Customer is still within her warranty time frame and her claim is still open as we are waiting on her part so we can ship it out to her. We have explained to the customer over the phone and via email that her warranty covers parts and not labor. If the customer should need anything else she can reach out to us at **********************************
