January 2020 i moved into ******************, managed by Mockingbird Management, I paid a deposit of $788. I informed them i would be moving and my move out date was January 28, 2023. I cleaned the apartment and moved but never heard anything from the complex. I assumed they were keeping my deposit, they are known to strong arm tenant deposits-historically. This is a lower income based complex, i have had several relatives and friends that have lived here over the years. Not the most desirable complex but when you are needing to get back on your feet-it helps. I was caught off-guard and shocked to learn recently that they claim i owe additional money and sent it to collections. I did not receive any notice about the reason i did not get my refund, any charges, etc. I did not receive any communications from them after i returned my keys. I sent them an email pointing this out and requesting documentation. I have my lease, photos, videos, affidavits of witnesses who helped me move and basically anything needed to research. They are keeping my deposit AND are demanding an additional payment of $312 and stating i forfeited my deposit and that is why there weren't deductions from the security deposit. I have reviewed the Texas Property Code, RRHA, TAA and various resources regarding the laws around this. I DONT WANT MONEY BACK FROM THEM, I WANT THE BALANCE CORRECTED TO 0.00 AND TO HAVE THEM CONTACT TENANT TRACKER TO HAVE THIS REMOVED FROM MY CREDIT.
