*************************** purchased a 2010 ***** 540 sedan ($700) and a 2013 Chevrolet Sonic ($700) through ******** Auctioneers online auction site. *************** (a duly state-licensed Towing and Vehicle Storage Facility) was the seller. We have never had a problem with ***************. They follow the letter of the law.
Both vehicles appear as transactions on a single Invoice. Our auction website, LoneStarOnline, functions like eBay. Sellers provide us with items to sell including descriptions and pictures. We post the items for sale with verbatim descriptions and terms and conditions, collect the money, and pay our sellers.
Lone Star Auctioneers does not take possession of consigned vehicles, nor do we provide descriptions, images, or title work. We do not impact the development of the listing information, or title work in any way. ***************, the seller, is responsible for providing the title work ******************** purchased both vehicles and is disputing the entire payment over a minor title work issue with one of the purchased vehicles. The registration office declined to issue a title because of an ambiguous numerical character on one paper document, a 3 was written that could look like an 8, and the title clerk declined to issue a title until it was corrected.
******************** is claiming the vehicle was purchased with paper that is registrable to the Collins County tax assessors office. The claim that it was registerable was never made by either Lone Star or the licensed tow company. The vehicle was sold with a Storage Lien Packet for title which is standard procedure following procedures required by law under the ***** ********** of ********* and Regulation (***** ********** of ********* and Regulation.)
His claim is not accurate. He claims that he was provided the paper given by Lone Star Auctioneers to register the car *************** had the only legal authority to prepare and provide the title work By law. Lone Star does not and never had the authority to provide title work for these vehicles. That is solely the responsibility of the towing company that sold the cars which was explained carefully several times.
Neither the vehicles nor the title work is ever in Lone Stars possession. The titles and storage lien packets are always provided by licensed vehicle towing and storage companies as required by the ***** ********** of ********* and Regulation. Furthermore, his claim that they were informed that the car is not registerable by law is also not true. It is registerable but needs the paperwork corrected which *************** has willingly agreed to do, and ******** is unwilling to cooperate for whatever reason.
The vehicle was sold with a Storage Lien Packet for title. There was one illegible handwritten character in the address line of a packet document, so the registrar refused to accept the packet until it was corrected. To rectify the problem, ******************** was asked/instructed by April at *************** to return the lien packet, and she would correct the discrepancy.
******************** did not return the packet to Purrfect or Lone Star and continues to refuse to do so.
To facilitate the title completion and resolve the problem the Vice President and Security Officer of Lone Star contacted ******************** requesting return of the packet to Purrfect for correction. ******** refused to do so. He is now uncooperative and has taken his grievance to the Better Business Bureau..
All ******************* must do is provide the lien packet to *************** for correction. They will correct it and try to facilitate his getting his titles. Lone Star paid *************** for these sales in full within five days of the completion of that online auction.
******** stopped payment on his credit card payment and the funds have been deducted from our bank account. At this point, ******************* has two perfectly good cars for free and refuses to take the simple steps to rectify the title problem, and Lone Star is out the total amount of his purchases which is $1400.00!Business response
