      I lived in a greystar property for about 3 years in Texas. Greystar was fine as a management company while I lived there and I was a great tenant who was never late on rent. The problem I have with greystar occurred about 5 months after I moved out. My lease did not have a security deposit so when months went by and no my old company didn’t contact me saying I damaged anything (I didn’t) I assumed all was good. I was wrong. Greystar more than 5 months after my leases ended contacted me saying I owe over 300 dollars for cleaning and repair fees (bathtub coat started peeling while I lived their and they said this wasn’t covered under wear and tear?) I throughly cleaned my apartment when I moved out and took pictures and videos I still have as evidence I returned the unit it great condition. No where in my lease did it say I would be charged for a professional cleaning it just said “if you don’t clean adequately you’ll be liable for cleaning charges. I did and when I asked for evidence or reasoning why I didn’t clean enough no pictures were provided. As for the bathtub the coat chipping after years of normal use is covered under wear and tear. I did no damage and only used it as intended so I am not liable for you to do routine maintenance on the unit. In addition because they waited more than 30 days (5 months) to give me a list of what I needed to pay them for they are acting out side of Texas tenant laws: Texas propert code 92109 “ A landlord who fails either to return a security deposit or to provide a written description and itemization of deductions on or before the 30th day after the date the tenant surrenders possession is presumed to have acted in bad faith.” Yes greystar is acting outside the law by not providing me a list of damages within 30 days. All talks with greystar to get these invalid payments dropped have gone no where. The next step will be court for a judge if greystar is outside the law and if I owe anything. Very disappointed in this shakedown..

      Mr. Sachse did not have a deposit on file, when he moved in all upfront fees were waived as a promotion resulting in a credit on his account in the amount of $425.00 and this was applied to his first months prorated rent.  The move in date was 7/2/19 total due for rent $1,184.52 and Fetch $14.52.  After the credit of $425., was applied Mr. Sachse paid $814.00 leaving him with a credit on his account of $39.96 which was applied to his August 2019 rent payment.  Please see attached move out photos, account ledger and final account statement.  The attached photos show more than normal wear and tear, the stove top was damaged and the tub was damaged.  Mr. Sachse lease also reflects Security Deposit of $0 in section 4 on the first page of the lease.  Please let me know if you need any additional information.

      I am rejecting this response because: no where in the lease did it say I’m responsible to pay for your cleaning service so long as I cleaned it upon move out which as seen in your pictures and my move out pictures I clearly did. The same goes for the carpet which I cleaned. I’m under no legal obligation to pay for these fees due to me cleaning them up to the standard outlined in the lease. As for the bathtub  I caused no direct damage to it I just used it normally for my 3 years living there. It is not my fault your paint coat was chipping due to me using it for normal use. I am not expected as a tenant to pay for the maintenance of your property.
