Exeter has thoroughly investigated the complaint and made the following determination. There was a total of three payments made prior to the vehicle being repossessed and sold at auction on December 9, 2021. Following to auction sale, on December 16, 2021, Exeter mailed ******** an Explanation of Calculation of Surplus or Deficiency letter advising of the deficiency balance owed in the amount of $6,637.63 to pay the account in full. A copy of this letter will be sent to ******** under separate cover for their records. As of the date of this response, the deficiency balance has not been paid off. Regarding ******** credit reporting, Exeter is bound by the Fair Credit Reporting Act which requires all accounts to be reported accurately and factually. Account information is furnished to the Credit Reporting Agencies ("CRAs") every month and will reflect the status of the account at the time of reporting. Exeter's records were reviewed, and the information reported to the CRAs, was confirmed to be accurate; therefore, no adjustments are necessary. I have no knowledge of this account that is reporting on my credit report. (a) Block. Except as otherwise provided in this section, a consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity theft, not later than 4 business days after the date of receipt by such agency of- (1) appropriate proof of the identity of the consumer; (2) a copy of an identity theft report; (3) the identification of such information by the consumer; and (4) a statement by the consumer that the information is not information relating to any transaction by the consumer. (b) Notification. A consumer reporting agency shall promptly notify the furnisher of information identified by the consumer under subsection (a) of this section- (1) that the information may be a result of identity theft; (2) that an identity theft report has been filed; (3) that a block has been requested under this section; and (4) of the effective dates of the block. Exeter Finance paid Cannon Honda in Vicksburg Ms for a car in my name,but I never got possession of this 2022 car.I spoke with Ms ********* and I fax them a letter.I called them several times but a supervisor never called me back.This company still have in system I owe them and I don't...They are ruining my credit score!!! I bought a Vehicle through Hall ****** Elizabeth City NC. The vehicle a used 2014 ****** in November 2020. I believe my whole contract is invalid but a lot of that is dealership related. As for Exeter I was required to have a Sterling *** warranty contract, $971 financed in at 28%. The vehicle was driving badly in March 2022. Took into Hall ****** Virginia Beach only to find out I needed singnifiget repairs of over $6000. I was told Warranty would have covered most repairs, but unfortunately the *** Sterling policy never existed wasn't put into affect! I do not have 6000 to pay on a XXXXX dollar loan. Told by salesperson to have vehicle voluntary surrendered. Only to be pressured into considering that and buying another vehicle on the 31st Match 2022. Feeling dishonest I turned new vehicle in and took old car back as I cannot with a clear conscious default on a loan even upside down, which I need to try to discuss with dealership why this way to start with! I was told I needed to take my vehicle back to Hall ****** of EC NC, to discuss warranty, only to be told again warranty wasn't ever. Into affect, but had it been my repairs wouldn't be covered. I was told no trade on a vehicle that needs that kind of work. Although paying 971 at 28% interest financed into 72 months. For a fraudulent warranty I have copies of! I need and should be refunded or let out of this inaccurate contract. I need a reliable vehicle and my credit is tapped out, not their problem I know. I have offers from ****** of 9400 until *** 5th 2022. I would like this to settle this invalid, contract without anymore financial loss or credit hit! What should I do??? What would Exeter do to me the client for falsifying a document??? No matter how you look at this that is over 1942 dollars + 28% interest Exeter is letting **** T***** get away with and me the Customer stuck with in a 62 month loan on top of value of vehicle! Exeter gladly accepts my payment and adds fees on for being late.This is money due to me if Exeter doesn't want to accept any responsibility in this matter. Exeter needs to back this amount with interest out of my Loan!Daily Exeter is calling wanting their 447.41 from me!! What are my consequences for Exeter ignoring this situation?? No vehicle, a loan that is based on two inaccurate amounts financed at a rate I'm told is above North Carolinas allowance to be charged on a Used Car Loan! When does Exeter,**** T***** of EC become responsible for writing, allowing and accepting false inaccurate documentation! Bottom Line Exeter has a cozy relationship and they don't want to Ruffle a big corporate relationship with***** One Automotive. They leave this to a single,disabled woman with a Mental illness to fight and deal with by herself! I will be including copies of both Loans! I had a stroke, yes it effected my mind, my body my thought process! Who stands up for my Rights??? I can't afford a Lawyer but I am going to look for a FREE Consultation! I bet Exeter and **** will acknowledge this mistake then! At this point Exeter will not finance a new loan for me, my credit already struggling has been run through the ringer trying to have a reliable working vehicle for Health and other appointments@ **** T***** EC just laughed and said we won't trade that vehicle knowing it needs a rear differential or fix it! That's real great customer service to a little person with two big Greedy Corporations!!! Exeter why don't you look at these two contracts and tell me why you didn't catch I have been charged with an AUL and a Gap full price on a vehicle I had only a few days! On March 26, 2022, I purchased a used car from my local **** Dealership. It was financed thru Exeter Finance. The first payment was scheduled for *** 10, 2022 for $537.63. A couple days after my purchase, I found my account on their website and decided to setup Autopay. On April 10, 2022, Exeter took the first payment out of my account one month before it was due. I called Exeter Finance and discussed the situation with them. They informed me that the first payment was retrieved early due to Autopay and they could not refund me the money. They suggested to go to my bank and have them file for a refund. I did as they suggested. The money was returned to my account. Now, when I check my account online with Exeter Finance, it shows that they are charging me a $30 penalty fee. I contacted them again and they stated that I was being changed a penalty fee because I had my bank refund that first payment, which is what they orignally told me do.Business response
