In late January, I contacted DB Integrity to provide an estimate for water mitigation services. I hired them and they completed the demolition and were paid directly by my insurance company for it. They also sent me an invoice for the amount directly, which I promptly paid. They did not inform me that insurance typically pays them directly for these services. After that, they rushed me to sign a contract on an iPad mini that apparently stated I would owe them the full amount of what insurance paid out to me directly for the rebuild claim or 30% of that amount if they did not perform any of the work. They did not make a good faith effort to explain what was in the contract. The contract was signed before the details of claim was even fully submitted by them the next day, so they interpreted the generic contract to be applicable to any amounts they independently submitted to insurance after the contract was signed. I told them there were several items of work that did not need to be performed, yet they submitted them on the claim anyway. They were unable to verify if any amounts were paid on the claim and pressured me into paying the 30% contract termination fee anyway. Furthermore, the amounts that they retroactively charged for the services that were performed were not previously agreed upon and were unreasonable. For example, I made it clear to them that the water mitigation services were not an emergency, yet they added "emergency services" as a charge anyway. They made no effort to remedy the concerns I had when I expressed them over the phone. Needless to say, I did not have faith in their integrity and elected to handle the rebuild on my own. They gave me a deadline to pay the contract termination fee and since I did not have time to deal with it at the time, I caved and paid them for work they did not perform. They tried cutting me a deal to leave 5 star reviews in lieu of paying the full termination fee.

DB Integrity reads and reviews the service agreement / contracts with all potential clients and ensures all clients are aware of what they are signing. The portion of the service agreement that reviews the 30% contract termination fee was reviewed in detail with Mr. ******, in which he stated he understood and signed. DB Integrity's policy is that we do obtain a signed service agreement / contract from the customer, before the work begins, so we may properly represent the customer, submit any estimates, and work with directly their insurance company, as we did for Mr. ******. This process and procedure was followed with Mr. ******, as it is with all potential clients. It is also explained to all homeowners, we perform all necessary work, listed in our estimate, and not just portions of our own estimate. While working with Mr. ******, we did work directly with his insurance company adjuster, ***** ***** from ******* ******, and was able to obtain payouts from her. Before a payment was made to Mr. ******, based on DB Integrity's estimate, she asked us to make one small adjustment (As part as the negotiating side of things) so she could issue out the payment. We agreed made the changes, in which I have attached a copy of that email. All of the line items on our estimate were performed and justified, even so that the insurance company agreed to payout on the estimate that we sent to them, once they finished their own review. We answered all of Mr. ******'s questions, even though he did not like some of the answers..like he is allowed to terminate the contract, but there is a contract termination fee. During and after multiple text messages, It became very apparent Mr. ****** wanted to exit out of our contract to find someone that would perform the work at a cheaper cost or to keep the Insurnace money for a monetary gain purpose. DB Integrity did lower the cost of the termination fee, in attempt to help his situation, by lowering down the $4200.00 contract termination fee to $1800.00 and giving us a 5 star review. Mr. ****** agreed, made the payment and left us reviews. He later went back to those reviews and deleted them, going back yet again on another agreement we made. Mr. ****** lied on multiple occasion in attempt to exist out of the contract he signed and DB Integrity has the text thread to prove it all. DB Integrity also has the emails and threads but this message will not allow me to include them all due to file size.

I am rejecting this response because: the claims made do not address the actual complaint and many of the claims are untrue.

      Regards,

All of Mr. ******'s false insinuations have been addressed. Mr. ****** signed a contract, under zero coercion, that clearly reviews what happens when someone wants to use and agrees to use DB Integrity's services and later decide not to use services, for any potential reason. Whether Mr. ****** decided to keep his insurance company's money for personal gain or use it to find a cheaper company was never determined and is irrelevant to the situation. Mr. ****** is requesting for a refund on an agreed upon amount that DB Integrity worked out for him and is now wanting that money back, based on the previously falsely stated reasons. A refund will not be issued to Mr. ******, as per the signed contractual agreement. Mr. ****** continues to breach the signed contract and will be handled accordingly.
