      On April the 4th of this year, I contacted *************************** about the possibility of renting space at his restaraunt 4 Bar K in *******, ** for a Celebration of Life event for my Dad who recently passed to be provided on May 20th. He told ** how much the rental would cost $2500. What would be provided, i.e. food, and etc and the length of time we would be allowed to occupy the space, and the deposit of $1000 to hold the date. My Mom gave him her **************** card and he ran it and then sent me an invoice via text message. We did not sign anything, and did not recieve any other paperwork from him. Several weeks passed, and we decided we wanted to find another venue that was more in character for what my Dad would have wanted. So I called him and cancelled the reservation. He stated that we wouldn't get the deposit back unless he could fill the space on that date. I told him, we never signed a contract, and he never stated anything regarding "Cancellation Policies". I looked, and there is nothing listed on his website. He got nasty. He also on the same day we cancelled, ran her AMEX again for $304. and then refunded it!!! We absolutely did not give him permission to do that which is illegal. I fully believe that he has no intention of trying to book on that date and just keeping our money. So, we contacted AMEX and initiated a dispute. He provided them with the invoice he sent me, and a "Contract" which we never saw which states, "Non-Refundable" deposit on the bottom left. Sorry, we never got that, he never stated that, it was never mentioned. We cancelled 25 days in advance of the date in question. Now, we're out $1000 for nothing. My impression of ******************** is not high to say the least. I am hoping for some degree of resolution here. I look forward to your response.

      ************************* did contact me concerning reserving the Four Bar K for their event on/or around April 3, 2023. I informed her of the cost to book the facility, food and audiovisual if needed at the cost of $2,500 with an upfront deposit of $1,000. I texted a paid invoice that also reads non-refundable deposit. This deposit is applied toward the balance one (1) week prior to event. The purpose of a deposit is to reserve that date and not rent it to anyone else. I did have other inquiries on this date and when I have a deposit I inform the interested party that it is already booked. The customer cancelled the event April 25, 2023, only 25 days in advance  of her event. I informed her that if and when I could re-book that date, I would be glad to refund the deposit.It would make no sense not to try to rebook for the obvious reason that I would make $1,500 more. The closer you get to the date the less customers call as they have usually found another venue. As far as the accusation that I charged an additional $304 to the **** card and then refunded that amount is totally false.

      I have been in business there for almost 32 years and treated customers fairly as I also want to be treated. If customers just cancelled whenever they wanted and expected a deposit refund,there would be no way to stay in business. Just an example of the importance of a good faith deposit.

      What if another group much larger called after I had a deposit to book the same date and I had the opportunity to make twice the income? I would not give up that date to make more. A deposit protects both parties.
