      They took over management of our duplex unit, we were the only ones still living there. The previous management company told me who to contact about rent and the new lease. June 29-30 I tried calling and texting while leaving messages about how to pay rent, nothing. July first I tried again, while adding in emailing. Few days after that I tried again. I didn't hear anything until July 8, in which I couldn't pay rent for July until the 10 when they finally sent me the portal to pay. They finally sent me the new lease July 14th letting me know the rent for September would be going up $500 a month, I proceeded to tell them I could not do that and we could be out by the end of July. They did a walk through with me, said everything was good and would get back to me about my $1500 security deposit and we have a forwarding address. It took more emails in the following month asking about the security deposit. Finally I got a reply September 14th that they would be sending an itemisation list for the deposit. I still haven't received anything following more emails until October 3rd which I was emailed an itemisation letter stating they would be keeping my $1500 deposit for not giving enough notice of move out. I then responded I was never given a chance to give enough notice to them never answering my calls, texts or emails and was always left completely wondering, as well with them not even sending me a lease or how to pay rent until the second week of the month.

We try diligently to negotiate terms that are a win/win between the owners we represent and their tenants. Your lease required a 45-day written notice of intent to vacate. Unfortunately, you did not give a 45-day notice, you only gave a 16-day notice. Additionally, ***** offered to create an intent to vacate for Sept 1, 2022 in his original email dated July 12th, 2022. This would have fulfilled your lease requirement and would have provided the forwarding address information that we needed to send the security deposit itemization under Texas Property Code. He additionally tried to negotiate on your behalf to work with you on the rental rate and sent you a few emails trying to work with you on terms. You indicated on July 12th that you were not sure if you wanted to sign a renewal. ***** reached out to you two days later to ask if you had decided. Additionally, on July 14th, he reached out to you via email with a negotiated reduction to $1425.00 which you declined and chose to continue with the 16-day intent to vacate. The security deposit accountancy, your lease and your lease ledger all indicate that your security deposit was $1050.00 not the $1500.00 that you stated. You were not penalized or charged any late fees for paying your rent on the 10th of the month due getting your tenant portal setup. We had to have documents signed by the owner prior to having any rental payment portals created and it was communicated to you that we were sorry for the delay. So I do not understand how this adversely affected you. We work directly for the owner of the property and follow their direction in accordance to Texas Property Codes. Unfortunately, it is valid that you did not give proper legal notice under the terms of your lease agreement.
