Me and my fianc made the mistake of signing a contract with Got it covered in September this year. We were initially impressed with their reviews and low prices and how much you got for what you paid. However, after learning this week that they were banned from serving at our wedding venue due to some issues that unfolded, we quickly realized their lack of integrity. I called ****** to request a refund and was quickly met with a refusal to refund us and claims that we should be the ones to pay her in full for the services not rendered. We've consulted with several lawyers who all state that we were entitled to rescission since Got it Covered was unable to fulfill their contract due to circumstances that were not reasonably anticipated at the time of signing the contract. Even still, she claimed that her contract stated no cancellations for any reason. Unfortunately, this will not stand well with the courts. There is an impossibility for performance, which entitles us to a refund regardless of what is stated in the contract. Impossibility is grounds to rescind the contract based on the law and supersedes everything else. I will send a certified letter requesting a refund due to this business's lack of accountability and willingness to make it right with the customer. Brides, it's not worth giving your business to a company that lacks integrity, even if you save a little more money. Spending money on a company that acts ethically and in good faith is better and will save you the stress in unprecedented situations like this.Business response

The client entered into a contract with Got It Covered Events to provide catering services for her wedding on April 20, **** at a venue called **************************. At the time of signing said contract Got It Covered was a preferred vendor at this venue. Since then, due to a situation unrelated to this client, the venue decided to end its business relationship with Got It Covered and did not grandfather existing contracts which is the common practice in our industry.
The following communication was sent to the client on November 16, 2023. We believe this is a reasonable compromise but she apparently does not.
As per our conversation, this is my confirmation that we will be issuing a refund in the amount of $1,574.52 on or before March 20,****. This is due to the cancellation of our contract to provide catering services on April 20, **** at ******************************. This cancellation was due to the fact that ************************** removed us from their list of approved caterers and decided not to grandfather existing contracts. We did not cancel this contract and were willing and ready to provide the services that we were hired to do and additionally we were willing to take additional steps so that the venue felt comfortable with our performance during the execution of the contract. Unfortunately, ************************** stopped all communication with us and refused to accept any feasible solution. I reiterate that this reimbursement is entirely as a courtesy in our part because although we feel that we were wronged in this situation, we also understand that you (the client) were not responsible for any part of this situation.
Can you please provide me a good mailing address to send this reimbursement to?Since then, the client has sent emails and letters threatening legal action and has filed public reviews questioning our integrity and calling us greedy. The delay in sending her the reimbursement is because we have multiple clients that have to be reimbursed and we are a small business with limited cash flow. Our intention is to prioritize the weddings in the order that they are happening. We feel our suggested compromise is reasonable but she is insistent and by pursuing legal action, filing this complaint and publishing unfavorable reviews she is only making it more difficult for us to fulfil our promise to her and all of our other clients.
