Advertising Review

On January 25, 2019, BBB Serving North Central Texas requested that Freedom with Sylverkatt, LLC substantiate, modify, or discontinue a multiple advertising claims on the several company websites.

The business advertises very large income claims such as, "I'm talking about increasing your income by 10x or more. I'm talking $20,000, $50,000 or even $90,000 a month", and also advertises that participants can expect "50,000 Blog Visitors in 30 Days or Less".

The business advertises work from home multi-level-marketing products for "100% free", yet charges "$7" for shipping and then auto-enrolls consumers into a "$297" plan. BBB is concerned that there is no way for consumers to opt out of this Negative Options auto-enrollment.

The business also advertises "Satisfaction Guarantee", and that it will "send you $500 just for wasting your time". There are no terms or conditions available to take advantage of these offers.

BBB requested that Freedom with Sylverkatt provide the FTC's required Business Opportunity and Income Disclosures, but they were not provided.

According to the BBB Code of Advertising, "any advertisement for a product or service that includes an offer to sell or provide consumers with additional goods or services under a negative option feature must include a clear and conspicuous disclosure of all material terms of the negative option feature.

Such material terms include: 18.2.1 The existence of the negative option feature; 18.2.2 The cost of the additional goods or services; 18.2.3 How consumers can cancel and avoid future shipments and charges; and 18.2.4 How consumers can return items that they do not want.

18.3 Advertisers must avoid making disclosures that are vague, unnecessarily long or which contain contradictory language. 18.4 Advertisers must not interpret the consumer's silence, failure to take an affirmative action to reject goods or services, or failure to cancel the agreement, as consent to enroll the consumer in the negative option feature. Instead, they must ensure that the consumer affirmatively consents (either online, over the phone, or in person) to the negative option feature before enrolling the consumer in the plan."

The BBB Code of Advertising also states, "'Satisfaction guarantee,' 'money back guarantee,' 'free trial offer,' or similar representations should be used in advertising only if the seller or manufacturer refunds the full purchase price of the advertised product at the purchaser's request. When 'satisfaction guarantee' or similar representations are used in advertising, any material limitations or conditions that apply to the guarantee should be clearly and prominently disclosed."

The BBB Code of Advertising also states, "Claims relating to performance, energy savings, safety, efficacy or results for a product or service should be based on recent and competent testing or other objective data."

While the business initially responded to BBBs request, as of February 18, 2019, the business has failed to substantiate, modify, or discontinue any of the advertising claims brought to its attention.
