Credit Karma told me to apply for a credit card and like a dope I did. The card was by Merrick Bank. I told Merrick Bank I didn't want the card and I cut the card up and threw it in the trash. Now Merrick Bank sends me a bill for $72.00 for an annual fee. I called them and said please cancel the card I didn't use it and don't want it. Now they send me letter telling me I must pay the $72.00 or be subject to a $40.00 penalty. Please help get them off my back please. Thank you very very much. Our records indicate that the account was opened with an annual fee per the customer's
pricing terms. Upon review of the customer's calls, we determined that our representative
inaccurately escalated the account to review an identity theft claim and did not close the
account as requested. The details of this call were forwarded to the appropriate level of
management to provide coaching so that the representative will better handle calls of this
nature in the future.
We have no record of a notice demanding payment or threatening a late fee other than the
customer's monthly billing statement. Our representative was unable to close the account
during the customer's second call due to the customer's claim that the account was opened
without their authorization.
As requested, the account was closed and the balance of fees waived. A request was
submitted to the consumer reporting agencies to delete the account from the customer's
credit file.

We regret to hear of any challenges that the customer may have experienced when
attempting to access their online account. In an effort to address their concerns, we
attempted to contact the customer by phone, but we were unable to reach them. According to
our records, the customer has successfully logged in to their online account since the ********************
complaint was filed. If they should experience this issue again, we request that they contact
our *************************** by phone at **************. A representative will be
happy to assist.

and used for purchases. Due to non-payment, the account charged off. Please note that we
have no record of prior correspondence requesting a copy of the application, as referenced in
their complaint.
Upon receipt of the customers complaint, we conducted an investigation into their claim of
identity theft. Based on the results of the investigation, the claim was denied as the account
information matches their personal details.
The Fair Credit Reporting Act (FCRA) requires that, as a furnisher of information to
consumer reporting agencies, we report accurate information regarding a consumers
account history. We have reviewed the account and determined that the information reported
was complete and accurate as of the date(s) we furnished it. As such, in the absence of

We confirmed that finance charges were assessed in accordance with the terms of the
account. Due to repeated non-payment, the customer's minimum payment due increased per
assessed late fees and was ultimately closed. The customer subsequently accepted a fee
waiver program and the aforementioned fees were waived after their most recent payment.
The account is presently current with an outstanding balance.

I was looking at my credit report recently and a little confused by an account I see. ********************** has reported an account as charged off and written off as a bad debt. However they are also reporting that the balance is still owed? While you have indicated this status on my credit report, I have not received a 1099-C form to reflect this debts cancellation, as would be expected. To clarify the status of this account, I am requesting a full audit of the account and access to *********************** ledgers associated with it. Additionally, I am entitled to know how much Merrick Bank received from any insurance claims related to this account as it would seem that any recovery would offset a balance they allege is owed and therefor they would be reporting fraudulent information to third parties like credit reporting agencies without my permission. This account is misleading and unlawfully damaging my credit profile. When I opened this account using my Social Security number, I transferred a security interest to Merrick Bank. As such, I am legally entitled to access the documentation relevant to this transaction and account history. Please be aware that if I receive only generic account statements, I will proceed with filing arbitration IMMEDIATELY per the terms of our original agreement. Furthermore, I will submit a report to the *** on grounds of potential securities fraud should Merrick Bank fail to provide the detailed records requested. This is my attempt to resolve this matter in good faith. Merrick Bank benefited off of the use of MY security interest in an open ended credit account and now I am being defamed with the negative reporting of that account. I have also sent this complaint to the *** and attorney general via the ****Business response

remains outstanding and has not been settled, the account does not qualify for a 1099-C
form. The account was reported to the consumer reporting agencies in accordance with the
customer's cardholder agreement. A response verifying accurate reporting was provided
directly to the consumer reporting agencies per the customer's indirect dispute.

and used for purchases. Due to non-payment, the account charged off. After charge-off, the
account was placed with third party collection agencies for servicing. Please be advised that
collection attempts were made in accordance with applicable laws. In addition, we have no
record of prior correspondence requesting debt validation or claiming identity theft.
Subsequent to charge-off we received payments, thus decreasing the outstanding balance.
Upon receipt of the customers complaint, we conducted an investigation regarding their
claim of identity theft. Based on our investigation, their claim was denied as the account

Our records indicate that this account was opened with an electronic application and used for
purchases. Due to continued non-payment, the account charged off with an outstanding
balance.
We received the customer's Automated Consumer Dispute Verification forms (ACDVs) filed
through the *************************** (CRAs) claiming identity theft and disputing the
reporting of the account. In each instance, the account was reviewed. Based on the results of
our investigation, the identity theft claims were denied and responses were provided directly
to the **** confirming that the account is reporting accurately. We also received two letters
submitted by a credit repair organization. In response, letters were sent to the customer
requesting that they contact us directly if they wished to dispute the account.
As disclosed in section 15 of the Cardholder Agreement, You also authorize us to furnish
information concerning your Account and your performance under this Agreement to
consumer reporting agencies (credit bureaus) or to others, but you acknowledge that we are
under no duty to do soWe may report information about your account to credit bureaus.
Late payments, missed payments, or other defaults on your account may be reflected in your
credit report and may negatively impact your credit score. The privacy policy also advised
that the account would be reported to credit bureaus and that this sharing could not be
limited.
The Fair Credit Reporting Act (FCRA) requires that, as a furnisher of information to consumer
reporting agencies, we report accurate information regarding a consumers account history.
We have reviewed the account and determined that the information reported was complete

Im still receiving calls for payment on an account that was paid in full on October 17, 2024 and Merrick bank has not sent our receipt for payoff when the money was sent via wire on October 17 and Merrick has confirmed that they received the wire and it is noted on our account on several occasions.Business response
