      We have unsubscribed this email address from all of our distribution lists. Our email distribution list is the only means of contacting consumers; our system does not include telephone numbers. Since we do not have any consumer telephone numbers or call our consumers, the reference to telephone calls this person suggests in the complaint is not understood. Unfortunately, this consumer never reached out to us by email (prior to their complaint with the BBB) to allow us the opportunity to resolve this directly with them. All a consumer needs to do to be removed from our emailing list is to either send an email to ************************************************************ or just reply to any email they receive from us and ask to be removed from all of our mailing lists.

      I have received many calls from the business at this address on file and so if this is a marketing agency that has been calling me please be advised that I will file a claim with the federal government and thereby take legal action against the number that is coming from the address in Draper Utah. If you are associated with the marketing firm I will file legal action against you also for selling my information.

      I, like many others, am receiving an inordinate number of unsolicited spam emails from a plethora of shell companies associated with BHK, LLC | *** * ***** * *** *** | Draper, UT 84020-7976 as well as Reactive Resources, LLC | **** **** ****** ***** **** * ******* ** ***** and am relatively certain that one of them shared my address with the other, if they are actually even distinct entities. I have attempted, finally after months of ignoring them, to unsubscribe from their various mailing lists and slight variations of email/website addresses. However in doing so I have inadvertently confirmed that this is, indeed an email address that will (eventually) respond and/or engage with these clearly spam advertisements. And hence, I have now begun receiving even more unwanted contact with these companies I never wanted to know existed in the first place and certainly never contacted on my own. I was under the impression we had laws to prevent this sort of activity, however they seem to continue these same practices unimpeded despite the mass complaints, both here, and on the wider internet in general. How many victims must complain before they change their behavior? Will anything short of a class-action lawsuit stop them? What is the remedy for this continued unwanted assault?

      I am rejecting this response because: not only does their copy and paste response ignore the fact I clearly laid out in my complaint that I did in fact contact them and the amount of spam emails increased. I am currently STILL receiving email advertising from the same parent company. I don't want to be removed from one email list I want to be removed from all of them. I also want to know where they got my info so I can be removed from those lists, and I want to know where they sold or shared my information since they are not alone in perpetrating this nonsense.

I see on the BBB website for this company that "Related Business" is Mama's Cooking, as is Cooking Professionally, Lazy Cooking, Recipe Saver, and Good Clean Humor, all from which I have also been receiving unsolicited, unsubscribed-to emails. The typical response from this company seems to be "Unfortunately, this consumer never reached out to us (prior to their complaint with the BBB) to allow us the opportunity to resolve this directly with them. All a consumer needs to do to be removed from our mailing list is to either send an email to ********************************** or just reply to any email they receive from us and ask to be removed from all of our mailing lists." However, I have unsubscribed (see attached), several times, in fact, and I believe unsubscribe means to be removed from a mailing list, and, if I am not mistaken, that then means to receive no further emails from the company a consumer has unsubscribed from. I want to make clear that not only do I NOT want to further receive unsolicited, unsubscribed-to emails from Easier Eats, but, from Mama's Cooking, Cooking Professionally, Lazy Cooking, Recipe Saver, Good Clean Humor and whatever other companies are under the BHK, LLC umbrella. To put it another way, I do not want to receive any communication from any of these companies at all, ever again. I also wish to be provided with the names of the companies under the BHK, LLC umbrella so that I may take further action if BHK, LLC does not comply with my request thus violating the CAN-SPAM Act, which they already have by continuing to, relentlessly, send emails even after I have unsubscribed, only a portion of which is evidenced by my screenshots. And, at up to $51,744 penalty for each separate email in violation of the law, it's hardly worth it, now is it?

      I have been receiving unwanted and unsolicited emails from Easier Eats for quite some time now. I have, on numerous occasions, unsubscribed at using the link at the bottom on the email. I have also responded several times requesting to be removed from their mailer list and requesting to never be contacted again from any of their "other" businesses. The most recent attempt to respond, only served to have them actually increase the frequency of their spam emails. I have blocked the email address to each of these spam emails multiple times, only to have them change something minor to avoid my spam detection software. My goal is to have them completely stop emailing me immediately. In the event they do not immediately cease and desist, I will file a complaint with the appropriate federal and state agencies. As to their boiler plate response here on BBB, stating they were never contacted to resolve the issue prior to taking this step, that is a false statement. I have tried that method several times, but they clearly do not read or seem to care about these attempts. Remove my email address (************************) from any and all marketing, contact, drip lists in your data base and do not share my information with anyone else.

      I am rejecting this response because:

      I am relieved this company has finally removed me from their email lists, but they are lying about my neglecting to reach out to them prior to filing a complaint.  I clicked unsubscribe countless times, and finally sent them an email requesting I be removed, and that I would be filing a BBB complaint if they did not.  I attached that email in my BBB complaint for reference, and they still ignored it, yet they continue to blame the complainants for not reaching out.  This seems to be the theme of this company.  Wait till they make someone angry enough to go through the effort of filing a complaint, then simply say...oh, we would have gladly removed them, if only they'd given us a chance.

      It’s not true that I didn’t reach out to them to resolve.

       

      I tried to “unsubscribe” from their spam emails NUMEROUS times, only to get subscribed to more spam emails from their partners.

       

      I had to get BBB involved to get them to unsubscribe me.

       

      The unsubscribe hyperlink at the bottom of their spam emails DOES NOT WORK. It only resulted in me getting more unwanted emails from their partners.

All a consumer needs to do to be removed from our mailing list is to either send an email to ********************** or just reply to any email they receive from us and ask to be removed from all of our mailing lists.") it is apparent to me that they have not actually read my complaint, nor, most likely will they read my reply. I did reply to the email by clicking on the unsubscribe link at the bottom of the email and that should be enough for a consumer to no longer receive those unwanted emails without having to jump through hoops by having to "either send an email to ********************** or just reply to any email they receive from us and ask to be removed from all of our mailing lists" unless of course, that unsubscribe (link) at the bottom of the email is only there for decoration. Just having an "unsubscribe" link without honoring those unsubscribe requests promptly is a clear violation of the CAN-SPAM Act. And, may I remind the company that "once people have told you" (which means communicated to you) "they don’t want to receive more messages from you, you can’t sell or transfer their email addresses, even in the form of a mailing list." I suggest that the business read the CAN-SPAM Act: A Compliance Guide for Business. Or, perhaps the company needs legal action taken against it in which injunctions and fines are levied. I will not hesitate to contact the FTC and the New York State Attorney General's office should I again receive emails from Easier Eats or any other compaines/domains under the BHK, LLC umbrella.

Likely this consumer is confused by what action "blocking" in their email inbox does and is not aware that their email service provider does not transfer that unsubscribe request to us.       With regards to the business's comment re: reaching out to them prior - I would encourage this business to consider that the (1) volume of their emails; and  (2) continuously changing email IDs that they originate from may not be perceived by recipients as indicative of 'good faith' practices on the part of this business.

      And, as such, recipients may be reluctant to engage them further.
