      Verisys has a database called Fraud and Abuse Control Information System (FACIS 3) that includes severe sanctions on healthcare providers such as exclusions and revocation for healthcare fraud and abuse, however, it also includes minor disciplinary action such as continuing education. My complaint is they are putting all healthcare disciplinary action into a category of fraud and abuse that not all actions are fraud and abuse. I have a **** on my dental hygiene license for continuing education and was denied a job because this shows up on a background check called Fraud and Abuse. Who gives them the authority to name a database Fraud and Abuse, compile data from thousands of databases such as OIG, FDA, *******, and licensing boards, and put everything into one category called Fraud & Abuse (FACIS 3)? Verisys advertises to "keep bad actors out of healthcare". Not every disciplinary action on a license is a bad actor, nor does it involve losing a license or being put on an exclusion list . This company is harming people and their reputation and certainly harmed me. I want my record removed from their database and the database name changed to reflect accurately.

      Verisys received a letter of complaint notification from the Better Business Bureau regarding a complaint filed by *******************, Complaint ID ********. We have looked into this complaint and would like provide the following response to the Better Business Bureau.       Response:

      FACIS (Fraud Abuse Control Information System) is the commercial name for a Verisys owned and maintained product consisting of primary source content from federal and state sources for exclusions, sanctions, debarments and disciplinary actions against health care professionals for all published license types and publishing jurisdictions. FACIS has been the industry standard since 1992.

      FACIS contains data from all federal data sources (OIG, SAM (including SDN), FDA, DEA, TRICARE, FBI, USDOJ, US Treasury Dept., US State Dept.) all state level Federal Healthcare Entitlement Program (FHEP) sources (State Medicaid Exclusions, State Contractor Disqualification/Debarment Lists, HEAT Task Force News, State Attorney General News, Federal District - Attorney General News, Medicare/Medicaid Opt-Out Lists). The FACIS data set also includes State Board and State Agency issued sanctions and disciplinary actions, which contain approximately 2,500 primary sources, with 800+ taxonomies in 56 jurisdictions. The search includes information on disciplinary actions ranging from exclusions and debarments to letters of reprimand and probation. Historical and current primary source records are included.

      Due to their own regulatory and legal obligations, our clients require that Verisys report all discipline found on any healthcare provider across all jurisdictions. Verisys does not make employment decisions. All decisions regarding eligibility for employment are made by the end user.

      **** ***** claims that the FACIS database is incorrectly categorizing board disciplinary actions as fraud and abuse.  As noted above, FACIS or "Fraud and Abuse Control Information System" is merely the commercial name of a product sold by Verisys. Our website clearly describes this product - "FACIS (Fraud and Abuse Control Information System) is a database maintained by Verisys that is comprised of current and historical records on health care providers, individuals and entities who have been sanctioned, debarred, excluded, or disciplined by federal or state government regulatory bodies and state-level licensing boards." To ensure that our records are clear, all records include the name of the source and all published details from the primary source.

      **** ***** was disciplined by the Michigan Board of Dentistry due to failure to fulfill the continuing education requirements for licensure.  The board issued a reprimand, imposed a fine, and placed license ********** on probation on 10/6/2016.  The probation was completed on 6/9/2017.  The license does not have any additional restrictions, and **** ***** is eligible to practice as a Dental Hygienist in Michigan. Verisys contacted the primary source who confirmed that online license information is accurate and up to date. The Provider is encouraged to call the Michigan Department of Licensing and Regulatory Affairs directly at ************ or by email at *******@MICHIGAN.GOV, if they feel the discipline/action is published in error.
