      On the 29th day of July, 2023 I signed a contract with Home Doctor Exterior via a Zoom meeting to purchase GAF Timberline HDZ Architectural Roofing System at a price of $10,621.00. I cancelled this contract on July 31, 2023, by registered mail (*************) because this contract is not in my best interest and I have chosen another company the suit my needs better. The sales person, *********************** never informed me that I could not cancel this contract but after I did he said the contract is "uncancelable." They are ignoring the Door-to-Door Act and have been harassing me ever since Saturday, July 30, 2023. His manager ********************************* has also harassed and threatened me with lawsuits since July 30th, 2023. I am a single 65 year old woman that lives alone and am tired of being threatened. I have called and left a message for CEO ********************* and all the Executives of this company and no one has returned my call.

      As the homeowner stated this is a virtual online sales and not a door-to-door act issue. Had the agreement be signed in-person on the customers property, than the federal right to rescind would apply. The purpose of this law is to prevent physical intimidation during a sale. There was NO physical presence of a sales person therefor this does not apply. We find this compalint to be slanderour and defamous as, again, federal right to rescind does not apply. We have forwarded this issue to our legal team and intend to defend our stellar reputation, recover anticipated profits, and legal fees of the contract which we are entitled per the law.

      I am rejecting this response because:  I have everything they said to me in writing.  This is not slander, but the truth.  They are bullies and have been intimidating me by text and email.  I have sent the email correspondence to BBB. I have screen shots of the texts that I can upload if needed.

      Per VA, MD, and Federal Law, this customer is in clear breach of contract. We have 2 contracts here at The Home Doctor #1 is for in-home sales - on this contract the customer has a Right to Cancel clause #2 is for virtual sales - this contract does NOT have a Right to Cancel clause. Not only are we will within our legal rights here, the purpose of the in-home Right to Cancel clause (which is a Federal law adopted and modified by the Sate of MD) is to prevent physical intimidation when in a consumers home. 

      Furthermore, the state of MD routinely sees cases like this and decides in favor of the non-breaching party.

      Not only is the consumer in clear breach of contract, we have obeyed all federal and state laws, and we have the clear right to sue for and recover anticipated profits of a breach contract. We have tried to avoid this option, but with the reviews and **** complaints we are forced in to litigating this matter per the terms of the contract.

      On July 11, 2023, the Home Doctor window technicians came to my home and did a fantastic job of replacing the 5 windows. The back kitchen window, however, had security bars on the outside of the house that had to be removed in order to complete the installation of that new window. The workers were unable to re-attach the bars I was told due to a lack of the type of equipment that was needed to fix it back. I was told at the measuring that there would be no problem in reinstalling the bars along with the windows. When the workers finished installing the windows and stated that they were finished, I asked about the reinstallation of the bars. I was then told that another crew with the correct tools would be assigned to complete the job by replacing the security bars. I reached out to the contact person. I sent her a text describing my situation on 7/12/23 and was answered with a text that she was in a meeting and would call me afterward. I have not received a return call from her yet. If there was a problem in reinstalling the security bars that I had been informed about in the beginning, I would have only purchased 4 windows and had repairs made to the kitchen window because the security bars are the priority for obvious safety reasons. I would like this job to be completed with the excellence that I am sure was intended from the beginning of this transaction. Please promptly schedule the necessary technicians with the necessary tools to replace the security bars at my address.Thank you,

      Two weeks ago I received a phone call from The Hone Doctor and ended up having to pay a down payment of $100 dollars. I emailed my sales Representative *** ******** regarding another quote from a company called ****** ******** their estimate was at least 2,000 less than the Home Dr's quote. It was my understanding with the home dr that They would Price match another written estimate. After I submitted that cheaper estimate from ****** ******** to the Home dr. I received a phone call from a supervisor named ***** who I told him about the other companies written estimate He said that he couldn't match The Home Dr Price with a substandard company such as ****** ******** to the Home Dr. He ***** even said that I couldn't cancel an online estimate or signed agreement with the Home Dr. Since then several phone calls text messages and emails I have sent asking for the $100.00 dollar down payment be returned to me Since I was not going to do this Home improvement project. No Representative from the Home Dr has contacted me regarding any measurements of my windows. Please take a look into my concerns with The Home Dr

      ****** ******** is notorious for using substandard windows and sub-contract installation. In our company presentation, we do have a price match promise page (see attached) however, it is clear we can not match apples to oranges. If we are competing against a company like Window ******, ******** *****, ************ ***** Windows, Re-newal by ********, or many of the high quality competitors - we will match price. When it comes to companies the sell strictly on price like, ****** ********, Window ****************** ***** and other companies that do not put quality first, we are not able to match price. Additionally it is true that internet sales are not covered in the Federal law that give the right to cancel within 3 business days - this law is specifically to protect again high-pressure in-home sales e.g. a sales person that won't leave with out a signature. On the internet there is no physical possibility of intimidation. The law is clear and if we are not able to proceed with the project than we are entitled to recovering anticipated profits via warrant in debt and a mechanics lien on the property.

      After speaking with the Home Dr Representative ***** telephonically and discussed the price Matching with the Window ********  we both were on the same page that I misunderstood the match policy.  With that being said I would like to withdraw my complaint about the The Window Dr.
