NAV Construction was contracted to install a concrete patio and masonry knee wall. They completed the patio but have not installed the wall. After several attempts to contact them I still have not been able to find out if or when they plan to finish the job. At this point per the contract we have paid 80% of the total in good faith. The schedule of values what they have completed is less then the fee break down. We have over paid them approx $1700. No one from their company has returned my call or emails. We would like your help in getting them to either complete the job or refund us the money we have over paid.Initial Complaint

9/13/21: we had our initial meeting with NAV (*******************************) to get an estimate. He (******) measured the dimensions for the driveway and patio. 9/27: we had our second meeting to discuss colors for the patio and fire pit, collect initial down payment, and sign the contract. At this meeting, there were no further measurements. The patio was spray painted. ****** told us that he would handle contacting miss utility despite the contract requiring us to do so. He stated they were scheduling a week out and we'd hear from him the week of 10/11/2021 10/18: first scheduling inquiry we made to NAV requesting a date.10/22: after asking about ****** notifying miss utility, we finally did so on our own. we notified miss utility and they completed the ticket on 10/26.10/23: told NAV we completed miss utility process. were then told we were scheduled for the week of 10/25.10/27: we inquired again re: start of work. were told 10/29 it was changed due to rain. NAV scheduled us to begin 11/2.11/1: ****** asked to meet the following morning to "go over everything."11/2: met ****** at 6:15 a.m. at which time we reviewed the work and he did his final spray painting of the driveway. no mention of change is cost or square footage was mentioned at all. 11/2: work started on driveway.11/3: Driveway and patio concrete poured. ****** tried to talk us into a different pattern bc forget the stamp we requested. ******** dad told us that his son "made a mistake" in the square footage of the driveway.11/4: patio sealed. second payment picked up. told that someone would finish the job 11/8 or 11/9. NAV texted re: change in square footage and cost. 11/7: confirmed color of fire pit text. 11/9, 11, 13, 15, 28 - we reached out to check status. no response.12/7: noted crack at end of driveway.12/8 contacted ****** and were told we "voided" the contract bc we did not pay his proposed charge to cover his costs due to his measurement error.Business response

It's very simple. My contract says final square footage assessed I'm fine with waiting for you which is the final spray paint they are there was obvious changes and when I told her about it she did not want to pay. I told him I just pay me my path he said he doesn't think he had to. No problem I finished the project for him and left him with 20% to have someone else hire.

I am rejecting this response because:It is really simple - ****** and NAV made a gross error in their measurement. That measurement provided the initial quote, which gave them the edge against their competitors. Then, this "final spray paint" tactic was employed to cover for this massive under-measurement, increasing the price, and relegating his initial quote as less than initially favorable. Whether intentional or simply a mistake, the fact is simple. This type of contractual loophole allows NAV to quote one price and then come in with a much greater cost after the fact, a tactic not that different from the illegal practice of bait and switch. His final comment "the customer isn't always right" tells us all we need to know. He did NOT finish the job, we are left with an expensive concrete project that has NO warranty, and he slinks off to the next gullible customer. I'd be in my right to sue and get NAV to finish the job and honor the warranty, but I don't trust that he'll cooperate, do a good job, or even reply to contact. In short, we don't trust and could never recommend NAV construction because the owner is untrustworthy.
