In March of 2022, I contracted with Greenslate to replace my small 50+ year old concrete driveway with an asphalt driveway. The area is approximately 350SF. After removal of the old driveway, Greenslate stopped work because a large tree root was found that was in the way of construction. I hired a *************** approved arborist, roots were cleared to Greenslates approval and work continued. On November 19, 2022 (less than 7 months after completion) I notified Greenslate of a 1ft crack that had appeared in the asphalt. They informed me the crack was "cosmetic" but offered two solutions, to seal the crack (not their recommended choice) or heat and repack the asphalt (their preferred recommendation). I went with their recommendation, and they came out in Spring of 2023 to heat/repack the cracked area. I notified them on 8/5/23 that the repair did not work and the area had gotten much worse (asphalt raised and cracked further). Greenslate now claims that a tree root has lifted the driveway and pointed to the lifted adjacent sidewalk as evidence. However, the referenced sidewalk lifted many years ago and has not changed recently. In fact, the asphalt patch that the City applied years ago is still perfectly intact, undisturbed. Given that the crack appeared so soon after driveway construction was complete, and that roots were cleared from the area to Greenslate's satisfaction just a few months before the default appeared, it is unreasonable to claim that a tree root grew fast enough and large enough in only 6.5 months to lift a brand-new driveway. Faulty construction, a poor foundation/prepwork/ashphalt application is the more likely cause, given how quickly the product failed after installation. I promptly notified Greenslate that I disagree that the tree root is the cause, and the contractor (both project manager and owner) has become non-responsive. I would like the area repaired. If they will not repair it themselves, I would like the costs covered to hire another contractor to evaluate the situation and provide a solution. An asphalt driveway should not have failed within 7 months of installation.
