      We are elderly homeowners who are being harassed by a company that has performed no work, provided no products, and have no lien rights. We signed a contract on 2/14/2023 to have heated gutters and gutter guards installed in the spring during one of the weirdest ******* we have experienced. We had frequent snowfalls, ringing several feet of snow, and frequent rainfalls in between, creating ice dam issues and water running down interior walls.This company salesperson spent 2 hours in our home, the extent of this companys efforts to resolve this issue. WE signed a contract, putting the 50% down payment expected on our charge card. It as our problems worsened and we didnt have gutters where the damage was, and snow and ice removed from our roof, it was apparent their product would not solved the construction issue we had, so we cancelled the contract within 3 weeks, and had the charge removed from our **** of America statement. Keep in mind, it stated that the contract figure was only an. Estimate, and work could NOT be fine til Spring, which didnt happen until mid May. Furthermore, our contract does NOT include an agreement to their Terms and Conditions. They now are charging our credit card $3,774, saying we agreed to that up to 20% charge, , in spite of cancelling the project long before Spring, and their continual harassment via telephone and email! Again, they have NO LIEN RIGHTS, have provided nothing but a piece of paper, and clearly are trying to bully 80 year old homeowners. It is outrageous! Their company website displays a huge showroom, warehouse, and many additional storage units, yet they profess that they had already ordered our product. It is implicitly clear with that huge facility, they have that type of product on sight. We are talking several feet of gutters we have been told comes in a roll that they cut on sight, not made to order windows, another of their products.I resent their dishonest, high pressure tactics.

      Good afternoon,

      Here are the facts on the claim submitted...

      At the request of the homeowner, a sales consultant with Asher Lasting Exteriors, met with the ***** and *********************** on February 14,2023. It was expressed that they had some covers on their gutters but they were not working properly and also had ice dam issues. Our consultant **** met with the *****'s and gave them a price on what it would cost to fix their problem. ***** and ******* entered into a contract for seamless gutters,downspouts, gutter helmet protection system and helmet heat reduction system. Both ***** and ******* signed the detail of the contract which included all pricing information and the terms and conditions of the contract.

      At this same time, the terms and conditions were also covered with homeowner.  Customer was informed that a 20% cancellation fee would be charged if cancelled beyond the 3-day grace ******* The terms and conditions were signed by *********************** and dated 2-14-23, the same day as the contract.

      On March 17th, 2023, ******************* informed our consultant, ****, via email that he wanted to cancel the order. At that time, he was informed of the cancellation fees involved.  A copy of the signed contract and signed terms and conditions were provided to customer.

      Our company has made multiple efforts to work with the customer on this project. The customer has not been responding to calls from the owner or consultant to discuss project options and cancellation fees. 

      At this time, a refund has been issued less the cancellation fee of 20%.

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

      Please type your response here.]This is the Terms and Conditions page that WE DID NOT SIGN!  Their salesman was here for perhaps 2 hours at which time we signed a contract, but my husband cancelled a short time later because the product Asher Exteriors were to install would NOT have solved the problem.  The issue was caused by condensation, a timber frame and stick construction which exacerbated the issue, and the Asher Salesman was not familiar with.   The  2/14 contract stated that the work could not be done until April or May, and we cancelled it in the first week of March.  My husband did not sign anything, and I only signed one side, not the Terms and Conditions.

      They have delivered NO PRODUCT, no Asher employee has set foot on the property since, NO WORK HAS BEEN DONE, AND THEY HAVE NO LIEN RIGHTS.  THEY HAVE ONLY MADE A SALES CALL.  They are trying to take advantage of senior citizens, 80 years old, during an extremely  unusual and stressful winter.   We had heavy snow, then heavy rain, then snow, then rain, causing ice dams that needed to be steamed off.  So many residents in this area experienced the same issues we did as a result.  Adding gutters would not have helped, only made the issue worse.

We have refunded the deposit, minus the 20% cancellation fee, as stated. Furthermore, it does not matter if our customer is 80 years old or 20 years old, we treat all contracts the same. To imply that we are taking advantage of the elderly is ridiculous. It also does not matter what the reason of the cancellation is. A contract is a contract and we maintained our end of the agreement.

      Mold/mildew buildup on bay window trim, Asher came out twice to insult me, and said they would call later about possible solutions of splitting the cost to repair/replace window trim. No call just ignorant comments, were made to me at my house.

      On May 9th, an Asher representative (*********************) visited my home. I signed a contract and put down a deposit of $3676, and was told that I could cancel in the next few days with no penalty. I contacted **** on May 10th to inform him that would be going with a different company.I was the only one who signed the contracts. Only my name appeared on the check I wrote to pay the deposit.It took until May 21 to receive the check from Asher returning my deposit, and the check was written to both me and my ex-partner. I could therefore not cash/deposit it. I contacted **** and asked that a new check be issued written out only to me. He said it would be taken care of and I would receive instructions for returning the faulty check. On June 1st I had not heard anything yet, so I messaged **** again. He said that he would be in my area on June 7th and out personally deliver the new check, collecting the old one. He never came.On June 8th, he told me he would be delivering it at 3pm on June 9th, but I got a text from him on the 9th that plans changed, and he was not coming. The notice of cancellation in the contact that Asher had me sign provides that the deposit will be returned within 10 days if I cancel. I finally received the check today, June 14th, 26 days after the 10-day period specified in the contract had expired. Asher was in breach of contract and did not allow me to access my own money for 26 days. Further, their company signed my money over (jointly) to a third party who had no legal involvement in the transaction. At very least, I believe that I am due interest on the money for the period during which they were in breach of contract. I was unable to invest this money, as it was in Asher's accounts, and I did not have access to it. I have attached the contract I signed with them. I have also included a screenshot of the text message from ********************* confirming that he delivered the check today (and collected the faulty one).

      Good morning,

       

      ******************************* did sign a contract and cancel her contract. We did have to reimburse the deposit in the form of a check, as the deposit made by ****** was already in our bank. At the time of the estimate, her ex-partner was her partner and was entered that way in our system as such. Our accountant did apologize for not knowing that and apologized for the mistake in not making the check to ****** solely. Our accountant was then on vacation for a week and therefor there was a delay in getting a check re-cut. Our accountant apologized that she was unavailable for the week and couldn't get back to her as quicky as she expected. Our accountant was back on June 13th and made out a replacement check and **** delivered it on the 14th. Everything is taken care of. We apologized for the delay. We will not be issuing interest for her deposit made on her cancelled order.

      My relationship status is irrelevant to a business contract that was signed only by me.  But because Asher does not seem to understand this, I'll provide more information.  I do not know why Asher is under the impression that my ex-partner was legally involved in the transaction, but he was not.  We split ** in October of 2021, so I have no idea where they got the impression that we were together in May of 2022.  In fact, when their representative was doing the estimate, I told him that I would sign the contract, but that I might have to cancel, because I couldn't get ahold of my ex, and I wanted his input.  Regardless, I was never legally married to him, so even if we were together today, that would have no bearing on a contract that I entered into alone.  Even if a couple were legally married at the time the contract was signed, married couples in ***************** are legally allowed to have independent finances.  This is why you can't access your spouse's bank account unless they give you permission.  Even in that case, it would still have been breach of contract for them to return one person's money to their spouse. 

      The fact remains that they were contractually obligated to return MY money to ME within 10 days of cancellation, and it took them 26 days.

      I'd purchased 2 windows from Asher Enterprises about 3 years ago and both of them have film on them. I've stop at Asher alot of different times. Yesterday I called up Ray that works for Asher as i just can't sit around and wait for them to come here. The film comes when it rain. As I paid over $5,000 for windows and I've been stopping there and it seems like they don't want to fix the problem. If they can't fix the problem just remove the windows at there cost and put some new ones in that don't have any film on them. I need some answers now and not the run around that I'm getting from Asher Enterprises and by the way Asher will be paying for the windows.
