I hired ************************* doing business as Top Hat LLC to fix damper in the fireplace and replace glass door in the fireplace March 21st 2022, I was asked to put 50% down total of $1,700 as it's listed on our contract. I was told it's going to take 9 weeks to get product in and installed. ***** never provided or reached out on status of the order and when I did ask when and if the product was ordered I was told over and over that it's on backorder (this went on until August 19th). I asked ***** if he cant finish the job if we can at least get the damper and glass door that he was going to order (never got response back) I also asked when exactly he is going to finish the job that I put $ down and *****'s response was "ASAP." I asked several time what "ASAP"means that I needed a date and if he cant provide that I wanted deposit returned. ***** response was "You broke the contract way past 5 business days with which leaves you no legal recourse" I still have not heard from ***** on exactly what" ASAP" means to him. ***** stole from me this is contractor fraud, he had no intentions on getting this job done.Initial Complaint

I hired ********* Top Hat LLC to replace materials and fix my chimney. I paid 50% down on March 24th with a check and cash for a total of $1400. I was told on the invoice the work would be done by Summer. I had to constantly touch base with the owner ***** and his wife **** on the status of my materials, when they would arrive and when I would be scheduled for the work to be done. I was told that on July 5th at 10AM ***** would be at my home to drop off the materials and fix my chimney. July 5th came and no one showed up and no one called me to explain why. On July 6th I sent them both a text asking my money back since no work was ever done and no materials were ever delivered. On July 7th I got a reply from ***** saying I will not be getting a refund, he is under no legal obligation to refund me and I can get my materials only. He still would not explain when that would be. At this point I am highly suspicious they have any materials at all and are just stalling and ignoring me. They took my money but never delivered anything. That's theft.
