I am writing in regard to the security deposit refund which I/we have not yet received. You withheld $1240 total. ********* Administrative Code ATCP 134.06(3)1 sets out the very specific circumstances under which a landlord may legally deduct items from a tenants security deposit. You wrongfully withheld the following items from my/our deposit:During stay, landlord frequently broke items in home including and not limited to: light switch at top of stairs when attempting to fix malfunctioning electricity never corrected, taking toilet out of downstairs bathroom without informing tenants and never replacing, by doing so was taking away item contracted to stay in home when lease was signed never corrected, after multiple requests to replace/place awning at front of house landlord asked tenant to complete for payment, tenant completed buying and placement of awning with address plate without complete compensation delivered to resident, $80 receiving out of $90 never completed, tenant agreed to keep fabric placed in downstairs ceiling of *********** in order to increase value of home for future potential tenants no compensation completed, tenants had to deal with potentially harmful, gray, egg-smelling water for entirety of stay with landlord refusing to correct is*** over 2 years. ******** attempted new well-drilling, however that did not correct is*** with landlord refusing requests for safe water to use for bathing of children and completing basic hygiene in home, an Because you wrongfully withheld my/our deposit, I/we have the right to file a formal complaint with Consumer Protection and to *** you for double the wrongfully withheld amount, plus court costs and attorney fees (********* Statute 100.20(5)).2 However, in the interest of time and energy, I/we will not pur*** these actions if you return $1240 to me/us by September 30th, 2022. I/We look forward to the prompt return of my/ our deposit .Thank you for your cooperation.
