I entered into a loan agreement with a bank for a plumbing job in my residence, agreeing to a loan amount of $3000.00 based on an estimate for bathroom remodeling or bathtub replacement. However, the plumbing company informed me that they couldn't travel the distance to my location to replace the bathtub, despite their website claiming otherwise. This led to the need for a revised loan amount of $1700.00, with the excess funds to be refunded to me. The bank sent me a new loan agreement for the revised amount, but I had already signed the initial agreement for $3000.00. I reached out to the bank for clarification, but they were confused about why the loan hadn't been funded yet. It turned out that the plumbing company was waiting for the bank to send me the "correct" loan documents. Despite the promised refund, the plumbing company deceived the bank by falsely claiming that the work hadn't been completed for several months. In reality, the work was done in a single afternoon. To make matters worse, I received letters from the plumbing company demanding full payment for the job, even though the loan hadn't been funded yet. Communication was lacking, and it seemed that the plumbing company and its owners were working behind the scenes, waiting for the revised loan documents to arrive and be signed. Eventually, I had no choice but to sign the new loan agreement under pressure from a bank agent, who insisted on the full loan amount being paid. Throughout this ordeal, I've been in regular contact with both the bank and the plumbing company. The bank claimed that they didn't modify the loan documents and blamed the plumbing company for the confusion. However, the plumbing company stated that they couldn't fund an amount exceeding the actual cost of the work. Neither the bank nor the plumbing company were willing to refund the excess funds or revise the payment, which was now past due because I received it after the due date. The plumbing company apologized for the incorrect information regarding their service department's ability to travel and claimed to be unaware of any limitations. It appears that they intentionally deceived the bank to manipulate the loan documents, while the bank seemed unconcerned by their actions. I enlisted a lawyer to handle the situation but later discovered that this "lawyer" was a scam artist who defrauded me. They sent letters to the bank, falsely claiming that the loan had been dissolved, which proved to be untrue. Believing that the matter had been resolved, I stopped making payments, resulting in missed payments and the loss of the zero-interest loan. This scam artist not only swindled me out of significant funds but also obtained my personal information, leading to multiple loans being opened in my name and damaging my credit score. The financial and personal repercussions of this entire ordeal have been substantial.

      Hello,

I am filing this complaint due to the plumbing company being untruthful in the loan documents as they refused to sign them until the correct amount was on the documents. In order for this to occur, the bank was told from the plumbing company that the work was not completed in my home. This work was completed in my home in one business day. Therefore the plumbing company lied to the bank in order to change those loan documents.

This file has been thoroughly investigated already by consumer protection and the ******************** of ********* Institutions.  The file was closed, and we have been informed by the ********* ******************** detective, *******************************, this consumer is now being investigated for fraud, and any further complaints and information need to be forwarded to them.  Please let me know if you need his information.  Below and attached are the initial responses given to Consumer Protection for your review.

In response to the complaint from the consumer concerning an unsatisfactory transaction with our

business, we found during our internal investigation of this transaction, everything was done

accordingly, and this was relayed to her in a series of phone calls and emails from July 14 -July 18,
      2022.
Both the consumer and her boyfriend needed some plumbing service done on their
home and requested to finance the transaction through *********************** (a 3rd party
finance company). We have this finance option available for customers who prefer to finance rather
than pay by check or credit card. (attached) They applied for financing and it was approved for up to
      $3,000.00 under her boyfriends name.
When it came to completing the work, the total bill was $1,757.97, which was less than the preapproved
amount. We replaced a pressure tank with a Amtrol WX203, and replaced the filter. As I
explained to her, we only finance for the amount of the project, due to us having to pay a
percentage of the total amount financed, to the finance company. We have to pay the finance
company in order to offer discounted terms for our customers. (example attached) After her
service, she wanted us to send a remodeling team out to replace a bathtub, but due to her location
and not having subcontractors in that area to complete that project we were unable to do so. Our
plumbing service division has a larger service area than the remodeling division due to the
subcontractors needed on remodeling projects. The consumer claims we told her we would give her the
difference of the $3,000.00 and the $1,700.00 to her in a check, but after interviews with those
involved this was not said. I told her, we unfortunately, cannot act as a bank, and cannot do that.
We only provide this finance option as an option for payment of the total service that is complete.
$1757.97 was the total amount financed, both the invoice and the signed paperwork by the consumer's boyfriend
      are attached.
From what I understand from the complaint, and how it should be resolved: She seems upset about
not getting the $1300 difference from the amount her boyfriend was preapproved for in the form of a
check from us. Like I explained to her beforeUnfortunately, again we dont finance more than the
project, nor would it be right to do so, so that would be impossible. If she needs the $1,300.00 cash,
she would need to apply for a separate personal loan.
I appreciate you taking the time to review our response thoroughly. I have included documentation
from the interview we had with *********************** also to help.
Please let us know if you need anything further from us on this.

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

First of all, I have just spoken with the detective investigating this other case, who I have spoken with previously in a lengthy conversation regarding this new issue which has transpired from your direct lies told to the bank who supplied to loan. The detective has informed me of no investigation being done towards myself after speaking with me previously. He did mention there were questions unanswered prior to speaking with me, however he has confirmed this investigation is not at all towards myself as you are stating. I find your response to be very inappropriate and unacceptable to be making such false accusations regarding this situation of which you seem to not have any accurate details.

For whatever reason you are still not able to address what my complaint is actually regarding, which is NOT about the loan itself, but your own false information you had supplied to the bank in order to change the loan documents. This work was completed in a single afternoon, which you instead told the bank it was completed several months afterwards. My complaint is regarding your lies told, which led to your changing the loan documents with no discussions of this being done beforehand. With the final loan documents being for the amount that the work was for, it was then that the signature from yourself was added to those documents. Your refusal to sign the previous documents and awaiting the bank to send the correct documents took numerous weeks. With your discussions with the bank in giving them inaccurate information regarding when the work was completed in order for your ability to change those documents is what this entire situation is regarding. The bank states this information in their reply from my Consumer Protection complaint. They state your ability to change those documents, but ONLY if the work is not completed. You stated to the bank this work was completed in June 2022. This work was completed many months prior and the proof of that is shown upon the date written on the appliance from the contractor who installed this in one afternoon in April of 2022.

Your untrue statements to the bank is what has led me to filing these numerous complaints regarding the concerns with how this was handled by your business. Not to mention the unlawful ways of changing loan documents which most definitely creates a large concern.

I'm also informed to advise you from the detective that he will be following up with both yourself, as well as the BBB if needed, in order to discuss this matter which you have spoken of that holds no truth. I have been told there is no investigation regarding myself with this other matter that has now transpired.  Therefore your words are not valid which you have stated regarding myself, which is absolutely unacceptable and inappropriate for such statements to be made or to continue to be made. Should you need clarification on this, I am also advised you may contact the detective to inquire about this yourself.

      Thank you,

      *******************************
