Tom *********** owner of JOLT Construction LLC. agreed to provide construction services for a bathroom. Half of the job was paid upfront in the amount of 2,100 dollars. Tom said he would start on Monday but never showed up and when asked when he would start said the following week. Again Tom never should up or contacted me. After asking him to commit to a schedule he said he could not, so I asked for a refund. He initially agreed to a refund. The day he said he would refund I never received any communications from him. I again asked when he would refund and he said Sunday. Again he never called or communicated until I asked him again for a refund. Then he had several stories about why he could not refund the money. I am attaching conversation from the ap he uses. He refused to use normal phone and text messaging and only facebook. Tom claims many things but is not willing to refund the money without a hassle. Tom never did any work on the main floor bathroom.

Hi my name is Tom ********** and I'm the owner of of jolt Construction LLC and I received a email from you guys saying in the customer has found a complaint against me regarding a refund I want to reassure you that I am not trying to cause any problems with the customer or be of any hassle or of any problem to anyone I want them the customer was aware that I was a single father recently divorced and trying to start my own business there's unfairly new I've only been in business like 4 months and I want you to know that the reason I was not there on the job when I said I would be because of my son had pink eye wish they was notified about and had no problem with but the second day I woke up with pink eye and I called to tell them that I wouldn't be back until my pink eye heald up cuz it was very highly contagious then I got a notification that Dean had no longer want me back in one of their deposit back but this was after I have done went over with him and looked at the bathroom they had it cleaned out we measured up the bathroom together we discussed designs and options with their bathroom together I repaired the water spicket to their tub and replace the plumbing to their toilet and put new valves in prior to them deciding to remodel the whole thing due to a water line break they had I also went ahead and repaired their steps because they were squeaky and loose and making noises I have a day or labor or so in that and did not charge yet for them they also have a few thing of my tools they're stating that they give me $200 for them tools which is way under the value of them tools to me what I'm concerned about is that I'm going to be in some type of trouble when I don't feel that I've done anything wrong and I've done what I could with what was out of my control I can't control whether I get pink eye or not but I tried to and I tried to communicate with them the best that I could prior to this I've done a buck upstairs remodel complete remodel to their bathroom for a low price in a fair price to them including a lot of extra work there was not added to the invoice but there was no issues there they was happy with the work being done until we went downstairs and I missed him few days of work due to that issue of pink eye. I don't mind refunding money that is owed to them but I want paid for the work that I've done already considering and adding the extra work that's been done and I'm adding the labor and material cost for the stairs I told them once I had that invoice made up I would send them to bill and if there is money that I owed I would give it to them and if there's money they owed I would like to have it they haven't given me any time to do so because I have offered and tried to discuss with them that I'm sorry that this has happened and that I'm willing to come down and I'm my eyes are better that I can come down and finish the work I started he refused to have me back there's nothing I can do more to try to make it right .. and to be quite frankly honest they have had several other contracts there that Dave had issues with and I'm wondering if it's just this is not a reoccurring thing that they do get you in there to do some work once you get to work started and get some extra stuff done before they pay you the second payment they fire you I'm not sure it may be need investigated further with other contractors having the same issue you can contact me at ************

The reasons that I was not there after a green apple and start date was because my son was diagnosed with pink eye a day later I ended up getting pink eye myself which day was notified and called and talked to about the situation it then upset them that I was not there and have asked for a full refund. But what did failed to mention that there was work done elsewhere to the house with no payment received. I repaired steps from the upstairs to the downstairs with new screws nails plus the labor on top of that which was a full day. They work that was done downstairs that did consider not work was me measuring up the bathroom coming up with new ideas and designs . I also repaired the plumbing inside the wall to the downstairs bathroom and the toilet plumbing was replaced. That equals up a lot of time that was not accounted for it. I'm not refusing to refund them money I'm asking them to give me time to get the bill figured up so that we are both treated fairly. Now mind you there was no issues with me doing the upstairs bathroom with a complete remodel this was not the first job I've done for them. Never had no issues but that other than I'm a single father and my kids come first and I do my best to work and provide for them and get them to school and so forth sometimes my babysitter was canceled I had no choice but to go home sometimes they would get sick I had no choice but to stay there. These were all things talked about amongst the two of us and they knew what was going on that's why I had to reschedule. As far as the refund the reason why I don't have the full amount  becausei buy tools to do the second bathroom  pink eye is something out of my control

the steps and repair them they said that they would love for that to be done also on the first contract it says at the bottom if there is any other extra work that it had to be okay  between me and the customer it was . As long as I had the work in the future i said I would be fair with them on the extra work .  I measurements up the first  bathroom . The homeowner is incorrect about the step repair there was underneath repairing  to rise and the runs .also work in their basement on the ductwork it was stated that I would add two vence to their  main duck in the paperwork but not tapping it. instead it had nothing about taping it and redoing some of the stuff that the homeowner previous done which is insufficient and dangerous to the house ventilation. I did all I want is to be paid for the time that I worked on the steps and paid for the taping and repairing of the ductwork and the time spent talking with homeowner on the first floor bathroom as far as them sending my tools to some address where I can do work that I am no longer there I don't know why they would do that why would they not send them to my house that makes no sense to me. The customer that they were sending my tools to has nothing to do with the job at their house I was referred from that customer to them they referred me to him did their new customer that's all that customer has any dealings with he dings no longer to be involved in this situation. Again I have offered to come back to do the job that I started that was promised to me in the beginning but since they backed out on the agreement I have no choice but to back out on me as far as the extra work that was the agreement from the very beginning I  . And I believe my personal life was only discussed between me and the homeowner and it does not mean to be

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

[Provide details of why you are not satisfied with this resolution.]

I can find no proof that any underneath work was performed on the stairs. I can provide pictures of current state and show nothing has been moved or taken apart in quite some time. Tom you have been paid in full for the first job. It is clear to me that you will not refund the deposit and will keep dragging this out by deliberately stalling and claiming as much as you can.

      Regards,
