The following prompts were in the medical information form required to be completed and returned by this participant:
"List any medication you will be taking on the expedition. Please also indicate what its purpose is. It is recommended that you bring additional medication of any prescription medications that your health is dependent upon, and an emergency supply be carried by the guides on your behalf.
Do you suffer from any chronic illness or disability such as: epilepsy, high blood pressure, nosebleeds, headaches, asthma, fainting spells, hay fever, heart conditions, diabetes, or others not mentioned here?
Is there anything else that may affect your participation on your trip?
Do you use /wear any medical devices? Hearing aid? Pace maker? or other?
Should there be any change in your medical standing before or during the expedition, it will be your responsibility to inform Coastal Bliss Adventures or its guides.
I understand that the expedition will involve strenuous activity and that I need to achieve a reasonable level of fitness in order to participate. Before the departure of the expedition, if I have any concerns whatsoever about my physical fitness or health, I will consult the opinion of my doctor immediately. I hereby certify that the above information is to the best of my knowledge true."
The participant failed to fully disclose his medical history that was relevant to a strenuous backpacking trip.
The lead guide had five years experience guiding, the assistant guide was a qualified, registered nurse. They know when someone is NOT in appropriate physical condition to complete a strenuous hike, and going to compromise the health and safety of self and others. The participant was blindsided only in the fact that he was not being truthful and hoping to get away with it by not disclosing important information.
The guides phoned the Directors of the company on the first evening, after having hikes a short, 700 meter distance for the day, and after reviewing the documents and what the participant disclosed to the guides that was different from what was disclosed on the forms, the Directors made the decision to evacuate the participant due to the high potential risks the participant was creating for himself and the others on the tour.
The participant signed the waiver form, which includes the following clauses:
"Coastal Bliss Adventures Ltd., although not bound to act, reserves the right at any time to refuse to allow a participant to continue the trip, if in the sole opinion of the trip leader, health or actions of the participants would affect the safety, smooth progress or enjoyment of the trip. In the event that such refusal or cancellation becomes necessary, Coastal Bliss Adventures Ltd. shall not be liable for any refund or for return transportation or any other expense for the participant.
Coastal Bliss Adventures Ltd. reserves the right and is hereby authorized by each participant to alter the itinerary at its sole discretion for any reason whatsoever, including changes in the weather, water conditions, mechanical failures, insufficient bookings, or any other occurrence. Any additional expenses incurred due to the alteration of the itinerary will be the responsibility of the participant and not those of Coastal Bliss Adventures Ltd. or its retailers/wholesalers.
That I have carefully read this RELEASE and that by entering into this agreement and signing the same, I am not relying on any oral or written representation or statements made by the Company including those in any brochure or calendars issued by the Company to induce me to undertake this Activity."
This participant is complaining because we made a completely appropriate decision based on safety that went against what he wanted.
