Purchase made may 2023 I purchased a power recliner and also bought a 5 year warranty. The recliner is stuck in a reclined position which makes getting on/off difficult. I reported the issue in store 3 times and was told 3 times to expect a callback within 3 business days. It's been over a month and I still get no phone calls. I do not believe they will honor the warranty, it looks like I have to live with broken merchandise.Business response

I purchased a mattress from Sam Levitz in January of 2019 and it has a 10-year warranty. They came out earlier this year and they said that it wasn't dipping enough in the middle and to call back a few months later. I sent a message to Sam Levitz in September and I received a text telling me that my warranty is no longer valid because they are going out of business. Yet I'm still stuck with a 10-year warranty on my mattress that is no longer valid now.Initial Complaint

I purchased a recliner chair for my mom on March 26, 2024. In July the massage portion of the recliner stopped working and Sam Levitz came out in July to look at it and said that they had to order a part. I called them a few weeks later and they said it wasn't in yet and then I checked again in August and they said it was not in yet. I kept calling in August and would leave a message and no one returned my calls, so I went into the store and they told me to text or email the customer service department which I did. I texted them and they said that the manufacturer has the part but they will not ship it to Sam Levitz as they are going out of business. Sam Levitz asked the manufacturer if they would ship the part to me, but they were not responding and Sam Levitz gave me there number and the ticket number. I called Moto Motion and they could not help me and told me to call Ashley consumer affairs. I called them and they said to file a claim online, which I did and it turns out they cannot help me as it is not an Ashley furniture piece. The chair is still under warranty and I also bought an extended warranty. I have asked Sam Levitz for a new chair or my money back, but they say they can't do that. I am sure because they are going out of business they don't care. I just want to get the part and have it fixed.Business response

Purchased furniture on 3/1/20 along with furniture I also purchased a 5 year protection plan. I was told if u didn't use it I would e refunded the amount. The company is now going out of business and is no longer allowing claims or refunds. I consider thus a breach in our contract. I paid for services they took my money and now they are telling me there us nothing that can be done. Is this true? Thank youBusiness response

I bought a leather couch from Sam Levitz, now 4 years ago. A rod popped out from the couch in July. I called Sam Levitz, couch was still under warranty. They sent a tech out, he said the deck was broken and put in a repair order. I called 2 weeks later, customer service told me they were waiting on the materials to fix the deck. I never heard back, and now they are going out of business and have NO customer service reps available.Business response

3/9/24 I purchased a bedroom set and a dining set. The total was 4970.60. Minus 1561.24 for 2 items removed from account in July. Most of which was on back order, which was a headboard, footboard with storage drawers and rails, A chest and a 5 piece dining set. Two nightstands and a dresser were delivered a week after purchase. The back ordered items I was told would be until mid April. I called in April and I was told end of May but they said the table and chairs were there and they were just waiting on the headboard. So I told them to deliver what they had and I would wait for the headboard. Then I was told until the end of June. On the beginning of July, I went in and spoke to the store manager Ryan. Don’t remember his last name. He told me it wouldn’t arrive until October. At that time he told me that they were closing 2 stores and that I should check those stores to see if they had any of my back ordered items. I took his advice and went to the sore on Prince Rd. It just so happens that they had the chest so I got it and was just waiting for the headboard. Ryan said I would get the headboard faster if I got it from Ashley furniture. We ordered the entire bed from Ashley furniture and received it on July 31. So they picked up the bed parts that we had with a promise to remove those items from my account and refund them. And to reimburse me for the warranty that we will not be using because they’re going out of business. He offered a 10% discount for our troubles on the wait. I have paid synchrony credit card company for all that I thought I owed minus the refund that I’m supposed to get from Sam Levitz furniture. But I have a balance of 1279.00 that I have to pay 75.00 every month to synchrony because I have not received my refund. I have a deferred plan that expires 01/2025 which will start charging me interest on the purchase. I am owed 575.56 for warranty, 647. 00 for the foot storage and rails that I returned, and 150.00 for the 10%. A total of 1372.56.Business response

We purchased two tables on Tuesday, October 1, 2024. The tables were to be delivered to two separate addresses. We paid in excess of $2,200 for both tables. Both tables were set to be delivered on Friday, October 4, 2024. The first table that came to 12135 N Seasons Loop, Oro Valley, AZ 85755 was the wrong table and we relayed the information to the delivery team. They said they would figure it out and get back to us. Then we were told the correct table would be arriving in 30 minutes. When they arrived with the second table, we discovered it was the table that was supposed to go to the other address, 901 W Calle Zoca, Sahuarita AZ 85629. The delivery team once again said they would get to the bottom of it. They all left. We received a call from Madeline at the Orange Grove location who said she was contacting us to fix the delivery issues. She stated that the second table could not be delivered to the Sahuarita address because it had been damaged when they were attempting to deliver it to the Oro Valley address but that they would get a replacement out as soon as possible. Then we received a call back from Madeline as she stated that the first table that was supposed to be delivered to Oro Valley was mismarked in the store and therefore they needed to charge us more money. I let her know that we would not be paying more because they messed up and we wouldn't have looked at the table if we knew it was that expensive. Madeline said she was going to speak with the manager, Charmaine, and call us back. Madeline called back and said they couldn't do anything to help and that they would have to cancel that table. We were very unhappy and said that they are in breach of contract. I then waited about an hour and followed up regarding the other table. I was told it was a no go. I asked what that meant and was told that they cancelled the entire order. Charmaine refused to speak and hung up on us.My mom is now without any table and is in cancer treatment.Business response

The response from the business talks about how they are going out of business but does not address our actual concern. We are not concerned about a warranty claim. We purchased a table that was mismarked in the store and were told all sales are final and we can not cancel our sale. Once the company delivered the wrong table twice they decided to inform us that the table was mismarked and unless we paid them more money they would be canceling our order. They are in breach of contract with regard to the sale contract that all sales are final and they are also in violation of The Arizona Consumer Fraud Act by not honoring their mismarked price that was on the table we purchased. The company does not get to treat people badly and violate laws just because they are going out of business.
