      Upon moving out of a rental property on April 13, 2023, our deposit fee of $835 was withheld and we were charged an with an additional $122 maintenance fee. The out inspection was completed on April 28,2023. On May 1, 2023, ***** * sent. an inspection email. On May 2, 2023, I responded asking for an itemized list for the bill via email, we were told by employee ***** *. that she would have to ask another employee. We did not hear anything back until November 8, 2023 that the $122 was due in 30 days and we only had 3 days from the time of the out inspection to dispute any charges. We never received an itemized list as requested on May 2, 2023 to further the dispute. The damages that are being charged are command hooks applied to the downstairs wall and a broken doorframe which was mentioned on a facetime tour of the home with ***** and she stated it would be fixed upon moving in. It was not nor were the pictures taken from the move in inspection of the broken doorframe. The pictures of the door were cropped to not show the door in full. The wall in pictures is not from the unit we rented. We have picture documentation that clearly show we had a brown doorframe and no command hooks on the wall. The picture we were sent in November showed a white doorframe, command hooks and the doorbell on the opposite side of the door than the the unit we rented. ******** is using a picture from a unit we did not rent to charge fees. The original email did not list two command hooks on the downstairs wall either. After sending the pictures on November 11, 2023, we were again told the $122 was still due in full in 30 days or our account would be sent to collections and we missed the time frame to dispute any charges.

      I’ve been renting with Holtzman Real Estate Services for 2 years. I started renting with them in March 2021. I put in several request last year 2022 about leak in the roof of the rental property I was living in. They never came out and fixed and anything. They continuously went up on the rent every year meanwhile my roof was falling apart. They also tried to charge me 400 dollars for a bedroom door which was fixed for 125 dollars. Holtzman is a rip off and doesn’t care about military people they just want your money. As soon as **** ******* received a bah increase Holtzman raised the rent again. They are predators! I told them I was not renewing the lease for this year 2023 and put in a 30 day notice. They suddenly became urgent wanting to fix everything and try to charge me for it. Before I was even able to fully move out the home they cut big holes in the living room ceiling knowing I had 2 little kids as well. Stay far away from Holtzman. I saw a ton of complaints on ** about them they’re ridiculous!

      The tenant told an employee during the standard walk through when notice is given the following: Tenant said leak in ceiling in master bath just started and she hasn’t had time to call in a work order.  The living room ceiling she said the leak was fixed but the vendor never came back to fix the ceiling.  Bedroom door is busted because she said her kids locked themselves in there and she had to break in. Naturally  our maintenance coordinator placed work orders for these items.

       

      When sending reminder notifications or the out inspection this was the response from the tenant.

      Good morning, this is Holtzman. This is a reminder that your OUT inspection for *** * ******** is scheduled for 3-29-23 at 9:00 AM. You are more than welcome to be present for this inspection, but you are not required to be. Please have the power/water on.

      I am rejecting this response because: They were notified since last year that this was an on going issue. I never told them the leak was fixed that’s a lie. I told the owner it’s still leaking and nothing still was done. The bedroom door is fixed so the 400$ charge should be removed it wasn’t Holtzman ‘s vendor who fixed it. Holtzman is definitely money hungry I’ve looked at several other reviews and someone else also complained to the bbb about them so that speaks volumes. Also redoing paint and carpet cleaning should not amount to a whole deposit being kept that’s ** and they know it. *** has already been contacted and requested to have them black listed.

      I rented a home from them and we were asked to leave because the owner wanted to sell. While we were leaving the last 2 weeks we were unable to stay there dur to the high temp and their inability to get the air fixed in a timely manner and they still charged us. When we left we took pic's of everything in the house. All lights were working and we put a new filter in for the air. We cleaned everything to the point it was cleaner then when we moved in. After a few weeks we received a bill for damages we didn't do, services that were not needed, and charged for bulbs and filter that was replaced the week we left. We have tried to contact them to get them to send pics of the damages they said we caused and all we received was a pic of 2 nail holes. When we move in there were holes they patched and didn't repaint the entire wall so we feel we shouldn't have to pay for the entire wall to be painted when it was not like that when we moved in. In our lease it states the house should be in the same condition when we leave as when we moved in and it was. We did have some holes we tried to get Holtzman to fix while we were staying there but they blew us off till we moved out. I again sent a email with pic's proving the house was clean, there was no damages to the entryway, and no need for new toilet seats, bulbs, or a air filter. We heard nothing from them for 2 months. After that we got an email with threats to take us to small claims court if we didn't pay them. I called again and was told to send proof to another email and they would look at it. It has been over a week and still no response from them at all. I have talked to several people who have rented from Holtzman who had the same experience of made up charges and damages. They were able to get their money back after they showed proof but Holtzman is ignoring my emails, refusing to show proof, and threating me without looking at my proof of their false charges.

      Regarding the A/C unit the work order was placed on 07/26/2022 we assigned the work order to our HVAC vendor. IT was found that the compressor had to be replaced. While owner was approving work tenant was provided with 2 window units. Owner approved compressor replacement and it was replaced the following week.

       

      I have also included our lease which outlines that toilet seats are to be replaced. They were replaced when they moved in.

      My first disappointment with this company started when I put my application in; Mrs. ***** said to me that upon approval of my application I will receive $65 back, money that she made me pay for the co-applicant. I never saw that money back. Then, at the time to move out, they scheduled a move out inspection on January 27th, 2022 and 4 days later on January 31st I received an email from Mrs. ***** in which she sent me a list of charges. I talked to her and stated my disagreement with most of the charges, but she only agreed on one damage related to the laundry room floor that was in the property before we move in. But she still charged me because the house wasn't full cleaned with materials needed and the carpet was not professionally cleaned. After I cleaned the carpets, I used odor powder and cleaned the house, as stated in the contract on section 14.B Condition of Property Upon Lease Termination. However, they failed to provide me a cleaning/move out instructions. If they wanted the property cleaned in a specific way they have to give guidance; per our contract on section 14 Upon Move Out it is clearly stated their obligation to provide this instructions. If Holtzman keeps record of my file and BBB does an investigation you're not going to find those instructions in my packet. Also, when I received the invoice I saw they charged me for utility activation when at the time of the inspection the power was on. If it wasn't, why didn't they list that on the move out list of charges? There are other charges in the invoice such as: drip pans, commode seats, baking soda, light bulbs and washable filter that are not listed on the move out list. They charged me for the kitchen wall, when nothing was done to that wall. I'll upload as supporting documents the invoice and the move out list of charges document for you to compare. I'll include the contract, the first inspection before I move in and pictures of the property when I moved out. They gave me $315.50 out of $1312.50.

      I have highlighted the sections of the lease for reference in the response.
      1 - There was a refund for the co-applicant fee of $65.00 to the card ending 4246 on 12/8/2020. Please see attached receipt.
      2 - The Out inspection was performed on Thursday, January 27, 2022. It was processed and sent to the tenant on Monday, January 31, 2022. Please refer the signed Residential Rental Agreement page 2, 6. Security     Deposit-I “Within three (3) business days of the termination of occupancy, Agent will conduct a thorough MOVE-OUT INSPECTION and provide to TENANT a comprehensive report of any damages done to the Premises during their tenancy via email. This inspection report will become basis for any possible damages against the security deposit.” Please see attached letter dated January 31,2022 with the list of charges. (This is within our 3 business days)
      3 - #4 on the list of damages was removed “Laundry room – damage to flooring will incur a damage fee of $50.00.”
      4 -The cleaning and was charged due to the property not being cleaned to the standards of Holtzman Real Estate Services. See attached in and out inspections.
      5 - Carpet cleaning was not pro
      fessionally cleaned our signed Residential Rental Agreement page 1 14. Upon Move Out – A – “All carpets must be professionally cleaned and receipt provided.”

      6 - Utility activation is referenced in the signed Residential Rental Agreement page 10 Exhibit “B” - #14 – H “We request that all Utilities are to remain “on” for 10 days after the “out “ inspection is completed. Unless otherwise expressed. It is also stated in the letter of list of charges under the “Disclaimers” section on the lower part of the letter the fees are to have the utilities turned on.
      7 - The charges for the drip pans, toilet seats baking soda, light bulbs and a/c filter are referenced in the signed Residential Rental Agreement page 10, 14. Upon Move-Out A – H all the requirements for the tenant moveout.

      Holtzman Real Estate required full payment of security deposit, first months rent and additional move in fees for renting a property before the applicant signs a lease or a lease is even struck up. I refused to pay for a property since they would not send me a lease to sign and required full payment before I could see a lease or sign one. But just wanted it out there that this could be fraudulent behavior, and that requiring money before seeing or reading a legally binding document can be problematic.

      Our policy is that the funds are to be received on the same day the lease is to be signed.  If the prospective tenant is not local or available (in this case the customer is located in ********) the lease is to be sent via ******** for electronic signatures once payment has been secured.  This practice is no different than any other online transaction and is in no way fraudulent. The customer wanted to sign the lease and then pay at a later date, essentially the prospective tenant wanted us to let him enter into a lease on December 1st, wait two weeks for him to mail a check on the December 15th. The customer was advised that all rentals are on a first come first served basis and understood such. Please see the attached text messages between the rental specialist and applicant.
