On 11/07/23 our company credit card was charged by Construct-A-Lead for a service that we previously canceled in May. The company advised us that we should expect a refund, but we never received one. They recently charged our card again, but we disputed the charge. This charge was too old to dispute, so we would like a refund.

On 11/20/2023, we paid $696.50 for an annual subscription. On 2/12/2024, we were charged $696.00. I reached out to our account **** ************************ about the issue. He apologized and said the billing department would reach out to us and get it taken care of. Since then, I have called every number, emailed every email address, and filled out every contact form I can find, numerous times, and have yet to speak to anybody. Over a month of trying to reach Construct-A-Lead with every avenue possible and not a single human is answering or replying, I'm just astonished a business can operate like this.

There is a fraudulent, unauthorized charge from Construct-a-Lead for $995.95 on my credit card that was charged on January 29, 2024! I recently received solicitation emails from this company which I marked as spam and deleted. I do not use or need their services, or any related services, and have reported the fraud to my credit card company. I will pursue further measures, as this is outright fraud. My credit card has been cancelled and law enforcement agencies will be contacted on Monday. My bank will be disputing this fraudulent charge on my behalf.

in Sept of 2022 we cancelled our contract with Construct-a-lead and was acknowledged by them. They charged us incorrectly in October of 2022 for $1099.95 then .It lay dormant until Last April since then we have noticed they have been charged our credit card since April of 2023 for $7890 for a total overcharged of $8989.95.Even after after discovering this and alerting them in December to this fact they have continuing to charge our credit card 2 more times - even as recently as last week.

SCAM! DO NOT GIVE THEM YOUR CREDIT CARD! I signed up for a yearly subscription for Construct-A-Lead on 12/30/22 and paid $1556.84 and was happily using the service. However, I was then charged again on 7/3/23 for another year even though I had already paid in full through 12/30/23. The company agreed with me in writing several times it was a mistake and sent me fake refund notifications, but never actually refunded to my credit card. They kept making excuses. Then they also shut me out of my account even though I had paid double. They do not have phone number that they answer and they continue to lie via email and send fake promises. For some reason, they are able to win credit card dispute also - as I was denied my chargeback even with all the supporting documentation. I had luckily already locked my credit card before they tried to charge me once again for another year for $1,995 on 12/30/23. This is crazy as the website says there is not account under my email since they shut me out. I am baffled that they scam their customers even though they also do provide the actual service. There are many others like me when I did a quick search about this company.

We closed our account and got email confirmation. Thereafter seller continued to charge credit card. When reported to our bank, seller produced fake invoices. Seller does not provide refund for the charges and makes a statement, 'charges over 4 months old cannot be refunded. This company continues to make unauthorized credit card charges for a subscription account that had a term of one year, 7/30/21 - 7/30/22, without an automatic renewal clause. We originally paid and authorized the payment for this stated term, but subsequently have not authorized renewals, and in fact formally asked for a cancelation of the subscription July 5, 2022.On 7/5/2022 a charge was made on our company credit card, and I promptly asked for a refund and cancelation. The sales rep in fact stated in writing that my account was not on auto-renew and that he would work towards getting ** a refund. This went back and forth via email and phone calls until I received a final email 12/19/22, telling me no refund would be issued and to take it up with my credit card company. That email also indicated that my billing account had long since been closed. This would indicate my account was closed and the cancelation processed, although no refund was ever given. I could not make a claim with the credit card company because it was too far past the charge date at that point, and I did not file a claim since I was told a credit would be forthcoming. On 4/17/23 another unauthorized charge was made on my credit card and I have been unable to communicate with anyone to get this reversed. Their email info@construct-a-lead bounces the emails back, the "chat" is unattended, the phone number ************ allows messages after many, many rings, but no one ever calls you back, I typed a message on the *** website page "send a message" and got no response, and finally the sales rep I had worked with is apparently no longer there since his cell number, ************ is no longer in service. I question the legitimacy of this business and since there is no way to communicate with them, it is impossible to resolve any issues.

I just spoke with BBB Customer Relations and was advised to submit this email.  I would like to request that BBB reopen the case I filed against Construct-A-Lead, now claiming to be Bidding Genius. I have no contract with Bidding Genius and the charges Im disputing on my credit card say Construct-A-Lead.  The response the business made to BBB about my claim is false and Id like to respond to this business statements.

      • My contract was for a one year period, 7/31/21 to 7/31/22.  I authorized Construct-A-Lead to make a one time charge to my credit card for $1099.95.
      • On July 5, 2022, a renewal charge was made to my credit card by Construct-A-Lead in the amount of $1099.64.  Construct-A-Lead had no authorization to make this charge or to continue the subscription.
      • On July 5, 2022, I wrote an email to my sales representative, *********************, questioning this charge, telling him I wanted to cancel, and he wrote back on July 11, 2022, stating that my account was NOT on auto-renew and that he would take care of this and send a confirmation once it was done.  ***** continued to talk with me via phone and I anticipated a credit for the fraudulent 2022 charge.  ***** left the company without securing my credit, and after 60 days I was beyond the time I could make a claim with my credit card bank.
      • On April 17, 2023, Construct-A-Lead again charged my credit card for a renewal subscription in the amount of $999.00, without any authorization from me.  Notice this time, the charged my credit card 3 months prior to when an annual subscription continuation date would have begun in keeping with prior subscription periods.
      • Construct-A-Lead indicated I have used my subscription beyond the first contract year, and that is not possible because they have locked me out of my account, my login hasnt worked since 2022.
      • I canceled my account in accordance with their policy, I canceled my subscription on July 5, 2022, in a direct email with my sales **** ********************** This is stated as acceptable in their terms and conditions.
      • I am still working with my bank and have reported the company as fraudulently charging my account for amounts not authorized and beyond the time when I properly canceled my subscription.  My bank had since issued me a credit for $999 for the fraudulent charge made on April 17, 2023, and is requiring Construct-A-Lead to furnish information showing I authorized any charges beyond the initial subscription agreement that began 7/31/21 and ended on 7/31/22.  Notice the Annual Renewal box is not marked, only New Agreement.
      • I am disputing their claim that I chose not to honor my contract.  My contract was for one year only, this is on the Subscription Agreement I signed 7/29/21, the allowed charge of $1099.95 is on the authorization, and I have proof that I canceled the subscription in accordance with their terms and conditions. If I had in fact renewed my subscription, then Construct-A-Lead would have needed to obtain my authorization to make the 7/5/22 charge of $1099.64, and again when they charged a third time on April 17, 2023, 3 months earlier than an annual subscription would have renewed in the amount of $999.00.

Please reopen this matter and request that Construct-A-Lead produce evidence that they have written authorization from me to make subsequent charges to my credit card beyond the termination date of the agreement and after I sent them notice in writing that I wished to cancel.  I you need to me upload the supporting information I previously furnished, please advise.  I have all documents pertaining to my claims and statements. Thank you.

      Complaint: 19986201

I am rejecting this response because: This merchant failed to act on our request to cancel the subscription.  Contrary to Construct-A-Lead's statement that my bank favored him, my case with **** has been reopened when I brought to ****'s attention that I had timely and accurately requested cancelation, and that it was in fact, Construct-A-Lead that failed to follow through on my properly executed request for cancelation, refund and confirmation of cancelation.  Sterling absolutely made our request for cancelation and refund within terms.

My initial request for cancelation and was on July 5, 2022, before the initial subscription was even over. The string of emails I have attached to this reply show the communication that occurred between myself and our Construct-A-lead sales **** ********************* and my notification to the "info@construct-a-lead" email you are required to notify. You can see that ***** acknowledges our cancelation, in fact states it was not an auto renew account and should not have renewed anyway, yet tells me he will cancel, request refund and will get me a confirmation for my request.

I attempted to call Construct-A-Lead multiple times, with no success.  I later learned ********************* left the company sometime before December 15, 2022.  No one else from Construct-A-Lead attempted to contact me, On December 15, 2022, (attached) I am once again attempted to get my refund from our cancelation of the subscription which occurred on July 5, 2022 and July 6, 2022.

I have included a screen shot of the login page showing that my credentials (which I did not change) do not allow me access to the subscription. I have paid for two years beyond the initial ending date of July 30, 2022, (see attached agreement)

It is not my responsibility, nor do I have access to cancel the subscription within the Construct-A-Lead system.  That ability is completely controlled by Construct-A-Lead which demonstrates how they can hold companies hostage for subscriptions for which cancelations have been properly requested.

I have repeatedly asked for Construct-A-Lead to provide evidence that I signed authorization for them to bill my credit card beyond the initial subscription.  They have failed to provide this.  They also never billed us prior to renewing, nor did they provide a receipt for billing us.  We learned of the charges when they appeared on our credit card.  Construct-A-Lead misleadingly sent copies of invoices and receipts for charges on our credit card to ****, yet when I asked for proof that those were in fact sent and delivered to us, they could not provide this evidence.  Anyone can print something and say they sent it. Construct-A-Lead should be able to substantiate their statements by showing date, time, to whom email was sent, etc.  They cannot because it was never done. Regardless, it is clear we made a valid, timely and proper request to cancel our subscription, this cannot be disputed.  Whether or not Construct-A-Lead does the administrative work on their end to cancel the subscription should have no bearing on the fact that I made the request.  Consider that their failure to cancel this allows them to bill me into infinity...and for a subscription they have locked me out of accessing.

Still to this day, Construct-A-Lead has yet to send me a confirmation of cancelation, which they say is required to cancel.  Their business practices are just completely unethical.

This is the basis for my complaint and rejecting their response to my complaint.

      Sincerely,

Very similar complaints as others. We signed up (4) years ago, and cancelled 3 years ago. They have continued to charge our credit card - which I have disputed each time only to have it reversed and it starts all over again. To date, we are out $3,085.53, and I cannot cancel my card. Ignore any positive review from this company. Very obvious they are so crooked that they even spend time to make accounts to try to cancel out any negative review. I had to contact my bank today since nobody ever answers. I canceled by account over a year ago and out of nowhere they continue to charge my card twice a month for ridiculous amounts I NEVER agreed to signed up for.
