I'm deeply troubled by the sharing of my nonpublic information with credit bureaus, leading to inaccuracies in my report. This has caused immense financial and emotional distress. Under 15 USC **** Section 602, I have the right to privacy. Additionally, 15 USC **** Section 604 A Section 2 prohibits furnishing accounts without my written instructions. Moreover, under 15 USC **** B, late treatment of payments on my account is prohibited.Please rectify these inaccuracies promptly to alleviate the distress caused. I write on behalf of Snap-on Credit LLC ("SOC") in response to the complaint lodged by ******************* I note at the outset that ****************** is not a consumer; rather, the contract he entered into with SOC contained representations and warrants by ****************** that he would use the product for business purposes, not personal, family or household purposes.
Second, and more directly related to the complaint, ****************** made only a handful of contractually required payments on the contract he entered into in September 2020. And SOC would be happy to send him a copy of the contract - all he needs to do is contact us at ************ and provide us with his current address (we note that his complaint does not contain his full address). Regardless, SOC stands by the fact that ****************** is a party to a contract with SOC and that he is in default thereof.

I attempted to make a missed payment correction and my snapon dealer refused. Simply stating that I wouldn't be their problem anymore and to have fun with legal department. The whole system is corrupt don't buy strap on tools. Needless to say the deal me and my credit guy made was not withheld as my dealer removed my contact info from my account and charged my account off. "I'm not their problem anymore." I note at the outset that ****************-doo is not a consumer because he did not purchase the tools for personal, family, or household purposes; rather, as he twice warranted in the two contracts he signed, the tools were purchased for use in his business as an auto mechanic or technician.

Took my property even though I never purchased from them. It was just in the vicinity of the repossession. I had to "pay the other person's debt to get it back". I did that, and they still did not return all of the stuff they took. They still are in possession of $1100 worth of stuff that was never even secured by the loan.Business response

Second, he has not yet responded to the ** Attorney General either.
Third, they still have the stuff as of today.

I write in response to **************** rejection of my previous response to this complaint. Once again, I disagree with **************** recitation of the facts. First, the August 28 matter was a review and SOC responded to it, contrary to Mr. ***** statement.
Second, SOC's response to the ************ Attorney General is not due until September 20, and SOC will respond timely. And finally, while SOC disagrees with **************** version of the facts with regard to this matter, SOC will not comment on this public forum while the matter is before the ************ Attorney General.

Those same agents refused to return those items to us upon request, we have three witnesses of their refusal. No debt is owed to this company, just give the stuff back so we can move on with our lives.

snap on CREDIT comes in to say that you can get tools and only pay 116$ per week- Once on the truck they scroll through to the credit terminal and tell you to sign- well not knowing what I signed now I realized that my payments of $116 weekly OR ****** A MONTH EVERY MONTH I PAY ****** which thought was good to pay my toolS evidently is not! they charge me $268 OR MORE each month for interest! and no I didn't know this- I thought my account was on the revolving 15.000.00 credit thing total PAY EVERY MONTH FOR 2 YEARS AND MY ACCOUNT ARE IN 18.000.00 SUPOST I PAY IN FULL IM 5 YEAR BUT IN MATEMATICS I WILL PAY LIKE 60.000.00 IN 20 YEARS bull that they scam people!Business response

I write on behalf of Snap-on Credit LLC ("SOC") in response to the complaint lodged by ******************. I would note at the outset that ****************** is not a consumer; rather, his relationship with SOC is commercial in nature because the contract(s) into which he entered were to finance the purchase of tools, tool storage, and diagnostic equipment for use by ****************** in his work as an automobile mechanic or technician.
With regard to the substance of his complaint, ********************** version of how contracts are entered into is simply not true. First, I would note that ****************** has entered into seven (7) contracts that have been assigned to SOC. When he entered into the 7th contract, his monthly payment increased approximately $10/week, so the notion that ****************** is surprised that he now owes approximately $500/month is simply unbelievable. Moreover, this is ********************** second BBB complaint regarding his payments. Because that is the case, SOC and his local Snap-on Tool franchisee have discussed his payment amount with him on numerous occasions and, in an attempt to keep him current on his obligations, SOC has provided him extensions on the payment due date. It just simply is not the case that he didn't know what the payment would be when he entered the contract, nor is it a surprise to him that the amount due each month is what it is. Finally, the contract contains a finance charge, so payments do not reduce the principal amount owed by the amount of the payment. Again, ****************** has known about the finance charges since entering his first contract.

1. On 07/07/2023, 07/12/2023, 07/17/2023, The *** denied and refused to perform his fiduciary obligations as trustee of my account in writing resulting in the material breach of contract. 2. The ***; who is only authorized to act as trustee proceeded to benefit from and act as beneficiary of an account which I am the lawful beneficiary of. As a result I could not utilize rights, titles, interests and equity that I am lawfully entitled to. 3. On 09/16/2019 and 07/03/2023 respectively the company was tendered security collateral from me in the form of two separate applications containing my trust account number and my signature giving The *** authorization to receive on my behalf, *************** notes in the amount equal to the amount applied for and to receive any further securities as necessary to further secure these contract agreements and related goods or property that were supposed to be transferred to me as the beneficiary for my benefit. 4. Concerning the security collateral from 2019; the company was tendered said security collateral, instructions, unearned interest in the form of payments or advancements from the agent on behalf of the principal, and took possession of the goods or property that the security collateral was securing in the first place. Concerning the security collateral from 2023; the company was tendered said security collateral, instructions, and kept in their possession for further sale the goods or property that the security collateral was securing in the first place. Concerning the security collateral from 2023; after taking in their possession related security collateral, the company further stated I was denied when I cannot be denied an extension of my own credit as that constitutes adverse action. I write in response to the complaint lodged by ***************************** on behalf of Snap-on Credit LLC (SOC). I would note at the outset that ****************** is not a consumer because he purchased the tools and equipment from SOC for commercial or business purposes, not for personal, family, or household purposes. The retail installment contract he signed contains two representations and warrantees to this effect.
As of the date I first began to draft this response, ***************** had directed no less than four (4) pieces of correspondence (hereinafter the Screed) to SOC in which he purported to appoint SOCs *************** ******** ********************************** his fiduciary for purposes of his account with SOC. ****************** also included documents within the Screed made to look like a negotiable instrument of some sort that purports to pay SOC in full for the tools he purchased and the deficiency balance that arose after SOC repossessed the tools.
In short, the Screed is nothing more than an attempt by ***************** to turn his obligation to pay SOC into, well, I am not sure what. However, in my opinion, the Screed is a sham and by directing it to SOC, ****************** is, in my opinion, attempting to defraud SOC. Accordingly, SOC is taking the following steps:
SOC is forwarding the Screed to the ************************ because it may constitute a scam to defraud it similar to that described here: ********************************************;
We are also forwarding the Screed to the ************* **************** for the Northern ******************** for potential violations of **** statutes regarding mail fraud and other financial shenanigans;
We are going to serve ****************** with a cease and desist demand that, if violated, we will forward to our outside counsel for possible civil litigation against ******************; and
Because ****************** is in default of the representations and warrantees he made in the retail installment contract, the payment obligations made therein, and his obligation to pay the shortfall that arose when SOC repossessed his tools, SOC is going to forward the account to its outside counsel for suit on the balance owed.
Since beginning to draft this response and today, SOC has received yet another document from ****************** in which he claims, among other things, the contract also states multiple times the amount of the credit being provided to my or on my behalf and you were tendered instructions on what to do with that credit It is clear that ****************** is continuing to attempt to convert his obligation to pay SOC what it is owed into something else. Accordingly, SOC will forward that document to the parties mentioned above.

I am rejecting this response because: As the company is aware I am a consumer as I was required to provide my consumer credit number on any and all applications to SOC. Unconscionable contract terms and unilateral contract decisions are violations of various UCC's etc. For the record I have not and am not attempting to convert my obligation into anything, I am simply performing my obligation. I tendered a negotiable instrument from a letter of credit I accepted on behalf of the principal that was accepted and not credited to my account which is interference with interstate commerce. I am in no way, shape, form, or fashion trying to defraud anything as you are already aware and furthermore if you don't even understand the international law of negotiable instruments administered by the ****** Nations about ****, can't state with any accuracy what I am doing and are further attempting to misclassify my actions as fraud you may want to refrain from making any false claims to any entity as that would actually be fraud (on top of the fraud you have already committed) and result in my direct filing of a ******* claim against you. I have already informed the *** of unusual activity via a report about an account that you took security collateral [Application, with SS#, and signature (Authorization)], unearned interest which no rebate was ever provided, and you took possession of property secured by my credit application pursuant to FRA sec. 16 which you were provided several copies of making this violation knowing and willful. You and your agents provided several false and misleading statements to mislead the consumer (me) on several instances. I reject in advance any cease-and-desist request you send as I am under no legal or lawful obligation to cease and desist the enforcement of my consumer rights you seem to be under the incorrect impression I don't have under any circumstances. I refer to BBB Complaint Case #******** for the record which I have attached the first page of to show a complaint I had to file against ************ for the same exact account in reference due to their violation of FCRA, FDCPA, Title 15 Ch. 14 Sub. Ch. I Part B **** and a plethora of others to which I received no response. The company did however remove the account completely from my credit report which is a direct acknowledgement of wrongdoing. "Silence [Failure to object or Performance on a contract] confirms the contract". Before they removed the account it showed and I quote "Paid As Agreed, Charged-Off", please refer to *** Topic No. 431 which establishes a charge-off as a cancelled debt, and that said account is closed to future charges. Snap-on credit has been adding thirteen ($13) dollars to the balance of this account each and every month from 2020 to the present. (Am. Jur. 7, p.982.) "dealing in ******* reserve notes, bills, notes, letters of credit bankers acceptances and other various forms of negotiable instruments etc. is acting under contract in interstate commerce and comes under the exclusive jurisdiction of the statutory laws of congress. Anyone using these chose(s) in action are statutory code law merchants" (UCC *****). "Bills of exchange, notes, checks, bills of laden and other negotiable and non-negotiable instruments are all essentially the same thing just made in different forms" (Am. Jur. 7, p.790). Merchant law governs commercial paper since "common law dollars" do not actually exist according to The Coinage ****************** declared there to be "no more General Common Law (state law), only ******* Common Law (Law Merchant)" ****************** **********************). "Everyone is a statutory law merchant dealing in Negotiable paper under limited liability for the payment of debts" (** v ****). In closing you will be made to remedy your actions either through this alternative administrative process or ************* District Court.

I am rejecting this response because: This response does not resolve or address any of the points made in my complaint or my previous responses. As you are aware "Screed" is not a legal or lawful term and is nonsensical in the fashion you are attempting to use it in. [Screed - is a thin layer of material that is placed on top of a concrete subfloor. Usually, screed consists of cement and sharp sand, but where a more industrial version is required, coarse aggregates can be added to create a thicker layer]. You are entitled to your opinion of what you think about what you are able to understand of my correspondence which your actions demonstrate is not much of anything at all. if you think Legal doctrine and case law is nonsense then that will prove to be very beneficial to me shortly. You are entitled to not act or disregard whatever you wish as I cannot physically compel you in one way or the other, but that does not nullify the lawful ramifications as you shall be made aware. Ignorance of the law is no excuse and not an adequate defense. I will take this response or lack of response as you seem to think it is as SOC and affiliated parties have no intent to remedy their actions pursuant to this administrative process and have no other recourse than to move on to judicial action. My personal information ( name, address, dob, ss#) was used fraudulently without my knowledge by my mother's friend (name listed in a police report, identity theft affidavit, FTC report). I found out in November 2021 when I noticed a statement from the creditor where he opened an account with MY name on it. I contacted a company where the loan was opened (apparently for some equipment) the person in charge seemed to be aware that this loan was opened without me knowing, in response to my statement this is a fraud he named my mother's boyfriend telling me that if he returns equipment account would be closed. I couldn't return since I never got it in the first place. Boyfriend disappeared. In January 2022 I started getting calls from SnapOn demanding payment, I called them and explained the situation, provided all documents to match the signatures, etc, and anything that was requested. They insist to get in contact with the person that opened the account through me ONLY because this person knew me personally! I don't have contact with him and I didn't open the account that is the main point. Later they tried to *** ME!!! I fought it in court and actually saw the forged signature on the loan, the judge saw that too and dismissed the case. It didn't, however, stop the *************** from continuing to report this fraudulent account to my ********************** report and harassing me with demands to pay for something I have never signed for and they are well aware. it is this company's representative's fault to allow someone to open an account with forged signatures and without verifying the identity of the applicant! I disputed the account a few times already with Experian, TransUnion Equifax, but they only reply -"remain unchanged credit verified account information matched"- OF COURSE IT DID ITS BEEN OPEN WITH MY INFORMATION!!!! I write in response to the complaint lodged by **************** against Snap-on Credit. Without going into detail, ******************** recitation of the facts and circumstances regarding the contract s at issue is not entirely accurate. But a couple of points need to be set straight. First, the underlying litigation was dismissed without any findings of facts or conclusions of law, including any determination that **************** did not sign the contract. And the matter was dismissed without prejudice to being brought again. Second, and more importantly, **************** has not provided Snap-on Credit with the *** Identify Theft package of documents, thereby inhibiting Snap-on Credit's ability to investigate her claim of identity theft (which, by the way, the Snap-on ************** Franchisee insists is inaccurate).
Nonetheless, if **************** will provide the *** Identity Theft package of materials to Snap-on Credit in its entirety, Snap-on Credit will undertake a further investigation into the claim. She can submit the documents to my attention at Snap-on Credit's ************ address.

I financed tools from a snap on tool truck with snap on credit. The contractor for snap on ensured me that if I returned his equipment that my balance would zero out and my account would be clear since I had paid down the balance of the tool so much I didn't have anything to worry about. Later I find our that he filed bankruptcy and leaves my account with a balance and does not notify me that my account still had a balance. I assumed he took the tools and sold them to another party privately and left me and my credit to suffer . I have text messages from him directly explaining him claining to be filing bankruptcy and all accounts were lost to that. I have 2 witnesses as well who were present at the time when i returned the equipment and was told my account was clear . This has burdened my credit and my ability to use my credit through snap on or other lenders due to lies and betrayal of a snap on tool truck employee.Business response

I write on behalf of Snap-on Credit LLC in response to the complaint lodged by ******************* I note at the outset that ****************** is not a consumer as the tool purchase (a scanner) he financed with a retail installment contract was used by him in his capacity as an auto mechanic or technician, not for personal, family, or household purposes. As to the substance of his complaint, ****************** has known since October 2018 that the scanner he returned did not fetch enough at re-sale to cover his outstanding balance. Since that time, Snap-on Credit has reached out to ****************** to try and resolve the matter, but ****************** has not entered into a payment plan or any other arrangement. If he would like to resolve the matter, he is free to contact us at ************. Snap-on Credit is willing and able to work with him.
I am not sure why he references his former franchisee's bankruptcy, but even if the former franchisee did file bankruptcy, it had nothing to do with the fact that ****************** owes Snap-on Credit money.

*************************I was taken advantage of and lied to by a snap on tool truck contractor/ dealer I have witnesses to him accepting the scanner in return and stating as such I would be left in good standing. I asked that question very question upon return and his reply was that I would not owe him anything after returning the equipment back to him In good working order. Prior to the purchase of this scanner i had bought another scanner from him which i turned in as tool creidt which with this the new unit was discounted by 3-4 thousand dollars including promotional offers at the time of sale .when I initially purchased the tool scanner i had very high equity left in the tool as well as when i returned it. since I was not upside down had no late fees and my account was up to date on payment. This has all been a misunderstanding and an all out lie . I was taken advantage of by one of your employees or tool contractors as I did nothing wrong . I was told I would be OK by returning the equipment come to find out he closed up shop filed bankruptcy thats why ininclude that in my statment sir. and left me with the bill. Where is that unit now. Hopefully your company has it in its position. If not then you know he sold it for profit and left me at a loss. That's the whole truth I shouldn't be a victim because someone felt it necessary to lie and take advantage of an honest working mechanic . Snap on credit should locate this scanner and really research this issue. I shouldn't be held responsible for any of this . I explained this same situation when we first made contact and was told the same by snap on its your loss and your balance pay up or accept the accruing interest on the account until you decide to pay off the balance . No help no research just tough luck and Were sorry but pay us no matter your situation. This shouldn't have happen and someone should investigate this further on snap on credits side . This I assume *** have criminal implications on the tool truck contractor. Especially if he made false claims and changed the numbers to show a loss . This whole situation is the fault of a crooked snap on tool dealer.

I write on behalf of Snap-on Credit in response to ********************** rejection of our response to his complaint. In short, a review of Snap-on Credit's records reveals that ********************** recounting of events is, at best, underinclusive. First, he doesn't mention that the Snap-on ************* Franchisee is not an agent of Snap-on Credit, but rather an independent business entity licensed to use the Snap-on name. Second, ****************** also fails to mention that the franchisee who accepted the scan tool told him when he accepted it that because the scanner was older and in poor shape, it would likely not fetch at sale all that ****************** owed. Furthermore, as I noted before, ****************** was notified on the deficiency balance in 2018. Since then, in February of 2021, ****************** asked Snap-on Credit to discontinue contacting him by phone, thereby ending Snap-on Credit's efforts to work with him to resolve the matter. As a result, the deficiency balance continued to remain on his account, and that is what Snap-on Credit has reported to the credit reporting agencies.

On may 12th an unauthorized 250$ was debited from my account without approval. This payment was taken after I made a payment of 555$ on may 11th the company refused to issue me a refund. They refused to supply me with the recording approving the authorized debit. ****************** was my representative. I was hung up on refused details and factual documentation showing my approval. They said for me to contact my bank to dispute the transaction and they can not help me for days. This company has left me with 3$ left in my account. I write in response to the complaint lodged by ***************** I note at the outset that **************** is not a consumer as the contractual relationship between Snap-on Credit and he is commercial in nature because the tools he purchased were for use in his work as a mechanic or technician and not for personal, family, or household purposes.
Snap-on Credit apologizes for the inconvenience suffered by ***************** While it is true that **************** did set ** bi-monthly payments in the amount of $250.00, that face was overlooked by both **************** and the Snap-on Credit Associate who took the $550.00 payment the day before the $250.00 payment was to run.
Snap-on Credit has arranged to get a check for $250.00 to **************** as soon as we can - as of this writing, the check has been ordered and I expect to receive it in the next day or two. I will make sure it is directed to **************** by overnight mail upon my receipt.
