I feel I am being taken advantage of their overcharging me for the job and they readjusted their price after my insurance company paid me for my damage. I had to hire other companies and people to clean up their mess.

      Disaster MD Response

      06/21/2024

On 3-8-2024, ******************* called us for water damage clean-up due to a pipe break in her basement. I explained the insurance process to her, told her she was only responsible for her insurance deductible and her insurer, State Farm would pay for the remaining balance. This typically takes 2-3 months of working with her adjuster to settle the claim with them and State Farm to issue a settlement payment. ************** asked me to speak to her contractor son and explain everything to him. He called me and I explained the insurance process to him as well. They were both in agreement. ************** signed our work authorization, client responsibility, release of contents, paid her deductible and signed payment receipt. I emailed ************** a copy of all signed paperwork and receipt for deductible and thanked her for speaking to me, call, text or email me if she had any further questions or concerns on 3-8-2024. ************** had a clean water pipe break, herself and son wanted me to cut out all drywall to 2' and dispose of carpet. I told her we could not do that without permission of her adjuster, doing so may result in denial of coverage for replacement. We must leave on site for inspection from **********, they have the option of restretching the carpet and repainting doors, unless she wanted to accept liability if coverage was denied. She wanted State Farm to pay. We can only dispose of carpet, drywall, doors, trim if it has sewage on it, in this case it was clean water pipe break. I spoke to her adjuster on site during inspection, adjuster did not give me permission to dispose of those materials. ************** signed a certificate of satisfaction on 3-13-2024 stating she was happy with our services. On 4-1-2024 I sent a detailed invoice showing the total amount due billed to State Farm minus the deductible paid, another copy of all paperwork and photos of mitigation to ************** and her adjuster. On 4-2-2024 I sent another email confirming I sent all paperwork and invoice for balance due from State Farm to ************** and hr adjuster. ************** nver contacted me, never addressed concern or dispute the amount billed to **********. On 6-4-2024 (two months after I sent billing twice) State Farm issued payment for the balance due on mitigation. I emailed ************** and informed her State Farm issued payment to her for our services. When speaking to the team member of her adjuster I was informed ************** was upset we did not dispose of carpet and doors. I explained we were not allowed to dispose of these items without permission (as I did during mitigation). I was never informed permission was given post-mitigation. If ************** would have communicated with me that permission was given I would have been happy to pick these materials up for disposal. It is NOT typical to replace carpet and dispose of doors from clean water loses and without being told there was no way I would have known. On 6-12-2024 ************** responded to my email stating she was under the impression the job was complete. She had to pay another company to dispose of her carpet, vanity and doors as well as put everything back where it goes in the rooms. She said after 3 months she got a bill out of the blue. I responded on 6-12-2024 explaining yet again everything and she was emailed her bill twice (4-1-2024 and 4-2-2024) after two months of having time to review her bill she is upset. Please contact me...no response. On 6-17-2024 I called ************** and left a voicemail. I followed up with a text message...no response. Later that afternoon her son called me and asked why I'm calling and texting his mom for payment.I explained everything to him AGAIN. He asked how long his mom had to pay us, I told him payment was due now. They had the check issued for our services that were completed over two months ago. He said ok, thank you and hung up. We still have not been paid. I feel like she is taking advantage of our company and attempting to keep the payment issued for our services, which is called insurance fraud and profiting from a loss. She refuses to communicate with me. I explained everything to her multiple times and her son, sent her two copies of her invoice in a timely fashion, then spent two months working with her adjuster for the balance to be paid. Never was called to pickup carpet, doors (never was told adjuster approved disposal after we completed mitigation). She signed certificate of satisfaction when we completed mitigation. Now she is refusing to surrender the check State Farm sent her to pay us the balance due. I have all emails, paperwork and photos as proof, I would be happy to send. Thank you
