Signed a lease on July 15th 2013 at The Domain at lenexa city center. It was said they were redoing apt for defective windows and doors. It was actually due to a undisclosed 5 yr lawsuit against builders, contractors etc for faulty construction that resulted in a 33 million dollar lawsuit for WATER DAMAGE AND MOLD. Had I known with my disability, long haul covid along with several other conditions but most serious is I have an immune deficiency and asthma. In November they started tearing off exterior of complex exposing the extent of damage. This is about when I started getting sick and per Dr's advice I moved out to see if it woukd make a difference and it did. I have not been able to return to live due to exposure to mold spores. Only time I've been in my apt in past 6 months was to retrieve some personal belongings etc. All 4 times resulted in er visits "mold toxicity" I gave a legal 30 day notice in February.was very hopeful that we could come to a mutual agreement but here it is July. I thought I could get out using my required Renters insurance but because they didn't disclose my claim was denied. I've incurred upwards of 35k in debt, my belongings are still in there and they had a court date without notifying me, knowing all communication we've had has been through email, text or calls. In a meeting in March, which I have recorded, I said to the manager that had I known there was prior water damage and mold, not as they called it "beautification " I would have never moved in. Their response"you didn't ask if there was mold". This is unimaginable. Who would even think of asking that question? Mold is very very serious especially to people like me w serious immune deficiency, asthma. Before claim was denied, I was told that everything must be remediated, cleaned, bagged,or thrown away. then found out they published all my personal property in the paper to be sold. I'm locked out. Being on disability is hard enough but to be treated this way is horrible.
