This debt collector engaged in abusive, deceptive, and unfair practices of the FDCPA which it prohibits. They furnished this account that we (me & AmerAssist AR Solutions) didn’t agree upon and I didn’t sign an agreement on. A legal contract is signed by two parties and I did not participate in any of it. This is a fraudulent account being furnished to my credit report. Also, I don’t believe they are even licensed and bonded to do business in this state (Illinois). However, they didn’t follow the proper 5 step validation procedure which makes this unfair practice. According to the FDCPA I’m entitled to 1,000 dollars per violation and clearly they violated my rights. Account # *******

I am writing to dispute the accuracy of the information on my credit report related to an account reported by Amerassist AR Solutions.

According to my credit report, Amerassist AR Solutions is reporting an account with a balance of $1,691.00. I am aware that this account is a result of the ******* data breach that occurred in September 2017, and I am disputing this information as it is inaccurate.

In September 2017, ******* experienced a data breach that impacted the personal information of approximately 147 million people. A federal court approved a class action Settlement, resolving lawsuits brought by consumers after the data breach.

It has come to my attention that Amerassist AR Solutions is reporting a debt on my credit file, even though I have never conducted any business with them. This is a clear violation of the Fair Credit Reporting Act (FCRA). I request that you conduct an immediate and thorough investigation into this matter. Amerassist AR Solutions should not be reporting a debt on my credit file without proper validation and verification of the debt's legitimacy, especially given the circumstances of the ******* data breach.

I am well within my rights under the FCRA to dispute this inaccurate information, and I expect a prompt and fair resolution to this matter. If this account is not removed from my credit report within three business days from the date of this letter, I will have no choice but to pursue legal action. I will file a suit with the Magistrate Court in Fulton County, Georgia, seeking appropriate damages for the harm caused by the false reporting. This inaccurate information has significantly affected my ability to obtain fair and accurate credit scores.

Enclosed with this letter are copies of relevant documents supporting my claim, including proof of my identity and any other supporting documents. I implore you to take immediate action to rectify this situation to avoid further legal proceedings.

The creditor, ***** ****** ****, placed the consumer's account with ARS for collection. The date of service for this account is 04/19/2019. The consumer set up payment arrangements on 11/12/2019 with a set of post dated payments. Those arrangements, however, were not met and kept. The consumer explained that it was due to their becoming unemployed at that time. Later the consumer disputed the account. On Oct 9, I called to accept a settlement they offered, but told them to not withdraw the funds until the end of the month (Oct 31). After getting off the phone with them, I received a notice from my bank and immediately called them back. The lady apologized and said her supervisor was going to refund my money, but I have yet to see it refunded. Now I have an overdraft fee.
