I hired **** ***** (Elements Outdoor Living/Elements Design) to create and install a new patio for my residence at **** *********. I contracted with him for the design, including a $375 payment, on 7/12/2022. A deposit of $9,200 for the construction portion of the project was made in good faith on 8/25/2022. A follow up phone call to **** was not returned in Sept., and an e-mail was sent on 10/18/22 notifying him of an issue with the demolition of the old deck that would delay the project. As I demolished the existing deck that the patio was to replace, I noticed that the rot extended into the house, necessitating replacement of the sill plate that was completed by another contractor in Dec. 2022. At this point, we had a general design, but were still missing specifics. I contacted **** by phone in Feb., and again in March, letting him know the work to the house was complete. We talked about ideas for a pergola as part of the project. However, after this call, **** then proceeded to halt all communication, including no responses to my e-mails of 4/20/23, 5/1/23, 5/15/23. **** did text again on 4/24 talking only about project colors (which had already been previously decided). On May 16th, I texted him about his lack of communication. He said he would look at the project, but had been busy. I e-mailed and texted him on June 12th (4 weeks later with no contact) that he was in breach of contact, and to refund my money. He e-mailed on 6/12 saying he was 100% on board, but would need to requote the project, and that the job would start within 2 weeks. I asked about the pergola dims. with no answer. He e-mailed a quote on 6/16 that had no attached quote, nor answered any questions. No follow up to my email of 6/18 or text of 6/20. Stern e-mail sent to **** on 7/7. A week later, on 7/13, he responded with drawings that still did not answer my questions. E-mails on 7/17 needing to requote. No completed design, lack of communication. Project at square 1, 14 months later.
