RE: ***** ******* **** credit card account ending in ****

      Dear **********:

This is in response to your concerns with fraud.

On October 26, you contacted us to report fraudulent use of your account. A lost/stolen report was completed on the account ending in ****, and all information was transferred to a new account ending in ****. Your card was shipped on October 30, please allow 7-10 business days to receive it.

Our fraud monitoring system detected a potentially fraudulent authorization attempt on your account on October 24 and 25. We declined the authorization and sent you a text message to confirm if this activity on October 26 was being attempted by you. You responded confirming that the $78.51 authorization attempt to ********************** was fraud, therefore the charge was not approved, and did not post to your account.

There is a charge to this same merchant on October 20 for $8.99 which you stated was yours on October 26.

You mentioned how you are unable to see pending transactions. At this time, we do not send out email confirmations. We appreciate your feedback and forwarded it to be reviewed for a potential future enhancement.

In some cases, a merchant may get an authorization but does not process a charge to the account. An authorization temporarily holds the amount of the transaction to ensure funds are available for purchase. While an authorization is pending, the amount will be deducted from your available credit. Not all authorizations are processed as charges and do not appear on your statement or online account unless they do.

We appreciate you being a customer and hope this information is helpful. If we can be of further assistance, please call Customer Service at ************.

Dear Better Business Bureau, I am writing to formally file a complaint against Premier Bank Card regarding a fraudulent credit inquiry and account on my credit report. Despite taking all necessary actions to report and resolve this matter, Premier Bank has failed to address the situation appropriately, resulting in ongoing harm to my credit standing. Upon reviewing my credit report, I discovered an inquiry and a newly opened credit line associated with Premier Bank Card. As I did not apply for this account, it is clear that it was fraudulently acquired. I immediately contacted Premier Bank to report the fraud, and they assured me they would investigate the matter and send me paperwork related to their findings. However, I have yet to receive any documents or communication from the company. In response to this situation, I took further steps to protect my credit and mitigate the impact of this fraudulent activity. I filed a police report, froze my credit, and filed a dispute with the relevant credit bureaus. Although Premier Bank removed the inquiry from my credit report, they refused to remove the fraudulent account, which remains open and continues to impact my credit. Moreover, it came to my attention that Premier Bank had already placed this fraudulent credit card on suspension before I noticed the issue, indicating they were aware of suspicious activity. Given my credit score of over 800, this should have raised a red flag for the company, as a high-score individual would likely not be applying for a credit-building card. Premier Bank's lack of proactive measures to prevent fraudulent activity, coupled with their inadequate response to my report, has left me feeling unprotected and disappointed. I respectfully request your assistance in urging Premier Bank Card to fully remove this fraudulent account from my credit report and to take accountability for their failure to address this issue in a timely and effective manner. Thank you

RE: First PREMIER Bank credit card account ending in ****

      Dear *********

This is in response to your concerns with an account that was opened without your permission, and you want the inquiry and account removed from your credit report.

On September 11, we received an online application with your personal information. Please be assured verification steps are taken on every application we receive. Due to potentially fraudulent activity associated with the address and social security number, we suspended the account and sent a letter asking for verification.

When we spoke with you on October 2, the account and all transactions were marked as fraudulent. Our Security Department investigated, found you not liable on October 23, and sent a request to have it removed from your credit report. Please allow 45 days for this information to update.

A request to remove the inquiry from your credit report has also been sent.

We are sorry this happened to you. If we can be of further assistance, please call Customer Service at *************

RE: First PREMIER Bank credit card accounts ending in **** and ****

      Dear *******

This is in response to your complaint in which you expressed concern with interest charges.

By opening a credit card with First PREMIER Bank, you accepted the terms of the account, including accountability for all fees and interest. Interest continues to charge on an account until its balance has been reduced to zero. Interest charges can be avoided on purchases by paying the new balance as listed on your monthly statement in full by the due date.

We hope this information is helpful.

I am demanding the removal of two accounts from my credit report due to clear violations of the Fair Credit Reporting Act (FCRA), 15 U.S.C. 1681e(b). The payment history on both accounts is inaccurate and inconsistent, with different bureaus reporting conflicting information for the same months. I have attached both accounts for your review. Additionally, account **************** violates the CARES Act by reporting late payments during the COVID-19 pandemic. This alone makes the reporting invalid. At this time, I am requesting only the immediate removal of these accounts from my credit report. If the accounts are not removed within 30 days, I will pursue legal action, whether through court or arbitration, due to your failure to comply with FCRA regulations. Any judge or arbitrator reviewing these accounts will clearly see the violations. For example, how can you report a 90-day late payment in November 2020 when the previous month shows 30 days late? This inconsistency demonstrates inaccurate reporting, violating federal regulations. Your actions have caused me significant harm and emotional distress due to the false information on my credit report. The following accounts must be removed immediately: Account **************** Account ****************

RE: First PREMIER Bank credit card accounts ending in **** and ****

      Dear *****:

This is in response to your complaint in which you expressed concern with credit reporting.

Following a thorough review, we confirmed we are accurately reporting your accounts. However, Equifax is inaccurately reflecting the late payment dates for your account ending in ****. Although we provide the same information to each consumer reporting agency, slight discrepancies are to be expected on their individual reports. We are sending an update to reflect accurate late payments for May, June, July, and August of 2021 on the account ending in ****.

The account ending in **** was opened in February 2020. It was closed in September 2021 due to inactivity, and the balance was credited to zero as a courtesy.

The account ending in **** was opened in February 2023 and it charged off due to delinquency in November 2023 with a balance of $313.34, which remains today.

Charged-off accounts and negative information remain on a credit report for approximately seven years, and accurate information is neither changed nor removed early. The consumer reporting agencies remove accounts at the correct time.

Early in the pandemic, we implemented a Coronavirus Relief Program to help customers when they let us know they couldn’t make payments. This program ended in June 2021, and we have no record of you attempting to enroll while the program was in effect.

Please refer to your Credit Card Contract regarding any questions you have about arbitration or your right to litigate. We understand you may choose to pursue legal action against First PREMIER Bank.

We hope this information is helpful.

You requested verification of debt and a correction to your credit report.

As the original creditor, First PREMIER Bank is not required to provide debt validation. We have no prior record of you requesting this information on these accounts.

These accounts were opened in March 2020 (****) and January 2022 (****), after received online and phone applications. We stopped receiving payments and determined the debts were unlikely to be collected, so they charged off in October 2022, with balances of $719.03 (****) and $1,041.50 (****), which remain today. Monthly statements were sent to the same address as the address listed on your complaint, until they charged off.

Charged-off accounts are removed from the credit report approximately seven years from the charge-off date, and accurate information is neither changed nor removed early. The consumer reporting agencies are responsible for removing the accounts at the correct time. If you feel the accounts are reporting inaccurately, please provide us with specific detail as well as documentation to support your claim.

If you have further questions or concerns, please call Customer Service at 800-987-5521.

      Sincerely,
