    State of Texas v. VA Claims Insider, LLC (Cause No. 2023CI25316)

    The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government's allegations, which have not yet been proven.

    On November 29, 2023, The State of Texas, acting through the Attorney General of Texas, Ken Paxton filed an action against VA Claims Insider, LLC for violations of the Texas Deceptive Trade Practices − Consumer Protection Act, Texas Business and Commerce Code §§ 17.41–17.63 (“DTPA”), and seeks a temporary and permanent injunction to stop Defendants from engaging in false, misleading or deceptive acts or practices in connection with the marketing or sale of goods or service to consumers by:

    a. Causing confusion or misrepresenting, directly or by implication, the actual costs of participation in Defendant’s membership programs;

    b. Causing confusion or misrepresenting, directly or by implication, the types of services offered and provided by Defendant or the benefits of such services;

    c. Selling or offering for sale VA disability claim preparation services unless Defendant has received accreditation by the VA; Plaintiff’s Original Petition Page 15 of 16 State v. VA Claims Insider, LLC 

    d. Offering to provide or providing Veterans with individualized, personal advice regarding a Veteran’s specific disability claims unless Defendant has been duly recognized by the VA to provide such assistance;

    e. Causing confusion regarding its affiliation with the VA; and f. Accessing or seeking to access the VA benefit information of Veterans through the VA’s eBenefits portal.

    To Whom It May Concern, I have gone back and forth about writing a review, but ultimately, I have decided to do so, just in case there are others who are afraid to speak up for themselves. I feel that I have received unsatisfactory treatment and service with your organization. I received a strategy session with one of your Elite Veteran Coaches (who I will not mention by name) providing strategic and step by step instructions on how to discuss and relay the symptoms and condition in regard to my mental state. To hear the response this individual gave me, "sounds like you know what you signed up for", was disheartening and a shock to say the least. How are you to encourage and prepare a veteran for opening up and becoming vulnerable with disclosing their traumatic experiences and nightmares while serving in the military with this preconceived mindset that was displayed. This is unsatisfactory and additional sensitive training and approaches on how to talk with veterans should be assessed and revisited. No veteran knows the story of another veteran and we ALL experience our traumas within the branches of service differently, yet ALL traumatically. This is why so MANY veterans shut down in isolation and end up taking drastic measures into their own hands, because of this type of service and not being understood with their mental condition. Your mission says, "educate and empower veterans to get the VA disability benefits they've earned for their honorable service". How can this be applied or even believed regarding a veteran's story, when you have them questioning their own horrific experiences and times, because the wording or response isn't what sounds service connected? I pray and hope no other veteran has experienced or goes through anything even relatable to something as humiliating as this, and hopefully hears the call for correction of this grievance complaint review.
