BBB requested that Zurvita more clearly communicate the existence of the company's negative option auto-billing and clearly communicate important terms regarding how consumers can cancel continued services.
~Satisfaction Guarantee
BBB requested that the business indicate whether it intends to provide full refunds. If so, BBB requested that the business provide clear and conspicuous terms and conditions explaining how consumers can receive refunds.
According to the BBB Code of Advertising, in relevant part:
"Claims relating to performance, energy savings, safety, efficacy or results for a product or service should be based on recent and competent testing or other objective data."
"Made in USA" and similar terms used to describe the origin of a product must be truthful and substantiated. An advertiser must not express or imply that a product or product line is exclusively "Made in USA" unless all or virtually all of the product is made in the U.S. All significant parts and processing that go into the product must be of U.S. origin. That is, the product should contain no -- or negligible -- foreign content.
Advertisers should only use "satisfaction guarantee," "money back guarantee," "free trial offer," or similar representations in advertising if the seller or manufacturer refunds the full purchase price of the advertised product or service at the consumer's request. When "satisfaction guarantee" or similar representations are used in advertising, any material limitations or conditions that apply to the guarantee must be clearly and conspicuously disclosed.
Any advertisement for a product or service that includes an offer to sell or provide consumers with additional goods or services under a negative option feature must include a clear and conspicuous disclosure of all material terms of the negative option feature. Such material terms include: The existence of the negative option feature; The cost of the additional goods or services; How consumers can cancel and avoid future shipments and charges; and How consumers can return items that they do not want.
Zurvita provided a clinical trial to serve as substantiation for a variety of ad claims but has not responded to most of the advertising concerns included above. While BBB acknowledged the clinical trial indicates additional testing may show health benefits, the overall preliminary nature, extreme limitation of human subjects, and short testing period would not constitute competent and reliable substantiation for health claims.
As of March 7, 2023, the business has failed to substantiate, modify, or discontinue the noted advertising claims.
