      We entered into an agreement with Dynamic Blending to commercialize skincare products and paid them $6,500 to do so. After 10 weeks of investment with Dynamic blending, we were forced to terminate the project with them due to severe underperformance in project management, execution, and work quality. Despite best efforts from our end, the project dragged out (10 weeks) with no satisfactory output that met the terms of our contract. Work on one of our formulas was never initiated, while the other two had unacceptable output. Dynamic's output was unacceptable for the following reasons: *Poor Handling of Requirements*: Despite our team providing formula specs with sourcing information, there were continuous misunderstandings of requirements by the Dynamic team, resulting in delays and mistakes in formulation. Samples created by Dynamic never matched our specs. *Nontransparent Ingredient Sourcing*: Ingredients sourcing by Dynamic to meet our company formula specs were incomplete and unclear, with no rationale for deviations from the specified suppliers. Instead of clear digital documentation, we were sent a photograph of paper notes with confusing notations and ingredient codes. *Poor Communication and Project Management*: Since the project kickoff, we requested updates and milestone dates but received vague responses, or in some cases no response at all. Due to the numerous instances of poor handling of requirements, nontransparent ingredient sourcing, and inadequate communication and project management, they provided no deliverable that met the contract terms - and because of this I requested a refund for the upfront fees they charged. Unfortunately after emailing Dynamic's CEO, Gavin Collier, he responded with an accidental reply all to myself and his lawyer stating "Hold him to our terms. I have found there is no benefit to go the extra mile with people." To-date they have continued to refuse to reimburse us for their fees.

      Dynamic Blending 100% misrepresented timelines and what they offer during the sales process. I purchased an R&D contract for my haircare business for them to perfect, large batch and then manufacture a formula that was already selling as we were small batching. I was very clear that we had a major PR push pending at the end of the deadline with some wiggle room as things do have hiccups and can take a bit longer. Dynamic stated they would seamlessly work with perfumers they "staffed" and also had relationships with, they also stated that they could quickly help with bottle sourcing during R&D if needed, they said they had design and distribution sales teams. This one stop shop was the catalyst for me signing their contract and starting with them. The process of R&D for our hair oil was not supposed to go past 14 weeks, 16 weeks at the most. Then the agreement was once the formulation was finalized stability testing would occur. which was a part of the invoice. Stability testing was to take one month and was an additional charge - and it was agreed that I would start manufacture during stability testing to ensure our PR launch/ influencer campaigns, and grant deadlines, retailer pre orders were met. 18 weeks in the team was dragging their feet and I demanded a call with their owner Gavin C******. Nothing got better. Instead we ended up going to legal because as the final straw after not providing bottle pricing per a request for 2 months they " highly" referred us to a perfumer and then 3 weeks later stated they could not work with them. This came after being a bit slimey and trying to nudge us to another in email after we had all engagement calls and told them we engaged the perfumer they highly referred. After telling them to stop work they rushed to send an unfinished sample to claim completion. 5600 in legal fees and communications later they are trying to charge storage fees for my bottles to return our stock to us and refusing a full refund.

      After careful review of the terms and conditions specified in our agreement, we regret to inform you that we are unable to issue a refund for the following reasons:

      1. Completion of Services. As per the terms of our contract, Dynamic Blending has successfully fulfilled our obligations by delivering the agreed-upon services outlined in the Order Acknowledgement and General Terms and Conditions. These services were performed in accordance with industry standards, meeting or exceeding the agreed upon specifications. See the attached Terms and Conditions of this project attached hereto as Exhibit “A”.

      2. Timeframe Issue. We acknowledge your concern that the project’s duration exceeded your expectations. However, it is essential to emphasize that the lead time provided in the onset of services was an estimate. We communicated from the outset that unforeseen circumstances or complexities during the project might impact the timeline. Our General Terms and Conditions page two paragraph seven, which Ms. ***** consented to, state that pricing and lead times are subject to change. See Exhibit “A”. Throughout the project, we maintained transparent communication, addressing any delays or modifications as they became known. After four revisions of the base formula requested by Ms. *****, The base formula is complete. The final base formula has been sent to Ms. ***** so that she can move forward with a third-party perfumer, which she requested to do in her July 30, 2023, email.

      While we understand that the project’s duration may not have aligned with Ms. *****'s initial expectations, we remain committed to delivering the highest quality of work within the parameters of industry standard and the terms and conditions. Dynamic is still willing to see this through. We have finished the base formula and sent it to Ms. *****. If Ms. ***** would like to continue working on this project and see it to the finish line and is more comfortable working with a different project coordinator, we can facilitate that as well.
      Although we have performed our obligations pursuant to the terms of conditions, we are willing to help her further, by waiving any storage, handling or cancellations fees in the amount of $2,200 to resolve this conflict.
      3.  Holding 7500 Stock Bottles Issue. In Ms. *****’s complaint under the desired response section, the following was stated, “Dynamic is holding 7500 of my stock bottles hostage for me to sign something stating they do not owe me a refund.”  This statement is false.
      On 9-20-23 at 10:09 am Dynamic Blending sent Ms. ***** an email with the following provision,
        “You asserted in your last email that you will lose money on the labels that you purchased if your materials are not sent.  In a good faith effort to prevent any losses due to expired shipping labels, I will instruct our warehouse personnel to use your shipping labels and deliver the pallets to UPS.” See Exhibit "B."
      On 9-20-23 at 10:28, Ms. ***** responded in part the following:
      “Hi *********- I just red [sic] your email and saw that you guys will be sending the bottles to UPS so we do not lose the expired shipping labels. i read too fast and honestly the entire process has been so exhausting and nerve racking while we are in the idle of a huge launch. I replied too fast. I very much appreciate that. Thank you.” See Exhibit "C."
      Pursuant to the Complaint with BBB, Ms. *****’s complaint was sent in on 9-20-23 at 7:35:39 pm, wherein Ms. ***** alleged in the Desired Settlement section that “Dynamic is holding 7500 of my stock bottles hostage for me to sign something stating they do not owe me a refund.”  Ms. *****’s claims have been made in bad faith and contrary to the contents of her own email.  Dynamic has not “required Ms. ***** to sign anything stating that we do not owe her a refund” nor has there been any mention or evidence of that statement anywhere.

      I am rejecting this response because:

      Though they have since I filed my BBB complaint returned my bottles Dynamic Blending is scamming people and I will follow up within court. 

       

      Note that they did not address the following facts:

      1) That they were supposed to work directly with perfumers, as stated and SOLD to me within the sales process. In the end the ONE THEY HIGHLY REFERRED, the could not and would not work with. See attached emails. They could not in any way send a completed sample as they owed me a fifth sample that was...FRAGRANCED. 

      2) See the emails where Carlie from their team stated they would be sending stock directly to the perfurmer and then never did. Because they played major games after and could not.

      3) In terms of clear communication I have ample emails and call that the owner Gavin originally MISSED to complain about lack of response time, communication and attention to detail and more for my project.

      4) Note that they also did not address that within the sales process that I was promised the project would compelted in 14 weeks, the MOST 16 weeks. These time frames are also on their website. You can see from my accompanied complaint email when I finally had a call with the owner it was at 18 weeks.

      I finally pulled the plug completely on the project because Dynamic is not only dishonest in ntheir practices but THEN tried to charge storage fees that were not originally going to be charged once I became fed up and pulled the project. Not only should bottles have not been sitting there but would not have been if Sdynamic Blending had done their job and completed the project.

       

      One the 16th Hugo from theri sales team sent the following email:

      'On Aug 16, 2023, at 2:45 PM, Hugo L**** <************************> wrote:


      ?Hi *******,


      Unfortunately, we are currently not working directly with the xxxperfumer name removedxxx and we would need to send the samples out to you, so that you can send them to them. You will need to deal directly with them moving forward and manage the distribution of the scent so that they can send it to us once we are ready to proceed with production, we will let you know the amount that we need once a final decision on the order quantity for production has been made, but you will be responsible of purchasing and supplying the scent coming from them . 


      The reason why the samples haven't been sent yet is because we needed to order more of the ingredients that we ran out of in order to make them. I checked with R&D and we almost have everything we need and will give you an update soon on when you can expect them.


      @Carlie S******* is out of the office this week but will be back on Monday and will continue to update you accordingly as usual.


      @Gavin *. C******, J.D is aware of the situation, and we apologize for the inconvenience that this causes as we continue to do our best to keep things moving along and take your project across the finish line."

      After speaking with my attorneys on the 17th I told them to stop all work. They claimed on the 18th samples were now ready from a 4th version to send unfragranced to me....when it was SOLD to me in the package and misrepresented to be sent and dealt with 100% between them and the perfumer. Weights, pricing, everything. They wholly misrepresented themselves and their capabilities. Gavin then wanted to argue that they had "previously told me" that samples were ready.

      They mailed a package of the unscented 4th version and uncompleted package even though they were told not to as they already legally had the stop work order. To add insult to injury the samples are dated....the 16th. The date I was emailed at 2:45pm to say they didnt have all the ingredients.

      They never provided bottle pricing and WERE NOT ABLE TO which would have told us how much we would be ordering. Which was also a major misrepresentation in the sales process.

      Prior to sending them the email listed above ********* from their team attempted to get me to sign something under duress stating that they would not owe me a refund due to storage and efforts and I sent her the following email which states I am not paying for their mistakes and mis-mangement.

      In terms of the costs that Dynamic incurred, just like any business you incur costs but when a project goes left there needs to be accountability. Gavin is aware it went left. I do not want to spend my time filing anything. I do expect a refund. What Dynamic was hired for was not carried out, from servers being down to lags in major replies, to never providing bottle pricing to not being able to deliver on promises with perfumers. I am a very patient person because I own 2 companies and believe in letting professionals do what you hired them for but this, was not professional at all so i do expect my refund. On your end for your losses, those are not my fault. I am not going to account for and pay for dynamics mistakes or mismangement on any level. Now would I expect my clients to. The trust was so thoroughly broken that on top of my costs to you guys my legal fees already paid in retainer are 5600 and we have extreme delayed retailer sales and influencers from Beyonce's camp totaling well into 100K. If you and your team had come to me and been honest and said you know what, we screwed up here and here. here is a refund and allow us to show you our final product. If you like it then we can recharge you and fully manufacture....that accountability would have gone a long way and gained major trust. instead I received emails with nonsense excuses and just an all around mess for someone I entrusted my entire new business with. There are ways to handle these situations with integrity and that was not it. Though I do appreciate you guys sending my bottles and that is one step to avoid litigation, I do also expect a full refund."

      1) I have flied a chargeback for the portion of fees paid on credit card.

      2) Given the underhanded nature and sheer misrepresentations throughout the entire process I will be filing immediately in court for additional refund amounts and damages.

      3) I have reached out to the Utah Attorney General with a formal complaint.

      4) I am also now looking to find a minimum of 11 other wronged clients as I am not opposed to a class action given the tenacity and overall foulness of their misrepresentation, underhanded behavior, and entire  situation. I am certain they will not be difficult to find given the way Dynamic Blending "does business.".

      Looking at past clients and reviews this seems to be a common scam they run but apparently its on smaller businesses without budget to go the mile for their wrong doings. That for sure will not be the case here. They have 0 accountability and thoroughly misrepresent themselves to what they believe are small businesses.

      Dynamic Blending remains ready and willing to provide one last sample with the perfume of her choice. If she would rather part ways, we are willing to waive storage fees in effort to remain amicable.  It is unfortunate that Ms. ***** is using this forum to defame and make threats to Dynamic Blending instead of negotiating a solution.

      I am rejecting this response because:

      There is absolutely nothing defamatory regarding my complaint. I am stating actual facts. I am also not making threats. I have clearly stated the actions I am taking and exploring for recovery of business damages.

      As I previously made clear to Dynamic Blending, we have already hired a new formulation specialist to begin the project from scratch.

      1) Dynamic Blending was supposed to complete the project in 14-16 weeks the most. 26-32 weeks is not a reasonable amount of time in delay. It is not a "disappointing" amount of time- it is a crippling amount of time in business and a costly amount of time. Their very own FAQ's section , screenshot attached stated the timeline they sold us. This screenshotted FAQ's section has since been removed from Dynamics website after previously pointing that out. From a call with their co-owner where I complained at 18 weeks I was very clearly told that " our formula was not at all complicated and had very few ingredients so it should not take that long.'

      2) Dynamic Blending could not provide a finished sample, 5 samples, as they could not work with the perfumer they highly recommended. At no point in time within our contract we is stated that we would receive any unfragranced samples. In earlier emails it is very clear where I told them to ensure each sample was fragranced as to not waste time. 

      3) Dynamic Blending provided us their preferred perfumer and then 3 weeks after we engaged them told us that they could not work with them and we had to work with them directly. They have not addressed this in any of their replies as that is what brought the entire long, drawn out process of mismanagement to a head. There has been 0 accountability. This came after me following up 4 different times and being told the samples would be sent. See emails previously attached. Finally I received an email stating they could not work directly with that perfumer because of...insert unreasonable excuses. This not only contradicts wholly what they recommended, but is not at all what we were sold in the sales process.

      4) Dynamic Blending stated within the sales process that they have perfumers they staff and work with directly and that we would not have to deal with any of the weights, price negotiations, shipping to and from them. This was determined not to be true as they attempted to push us to deal directly with the perfumer. At which point we sent a stop work order.

      5) Dynamic Blending stated in the sales process they could provide bottle pricing and jar pricing for later products. We did not ever receive that pricing which would have played into our order quantities and order costs to ensure effective planning after 2 months of requesting it.

      6) The reason a stop work order was issued was because at the point of the perfumer debacle I notified my attorney that I no longer trusted Dynamic Blending and could not see going through additional problems in formulation finalization, and mass manufacturing production. A-lot goes in to creating a product, including final product, how it is delivered and will it be in a sellable condition, time frame, ingredients and more. I do not care to take these additional risks any longer with Dynamic, so I will not be accepting their offer of yet another sample. 

      7) We have already engaged another manufacturer a this time.  

      8) They did not even offer to refund stability testing which could not have been done without a final formula and was agreed to be performed for one month following completion- so it could not have been completed during.

      9) In a previous reply Dynamic stated they did not ask me to "sign anything". Allow me to correct and attach the accompanying email for their "defamatory" claim. Dynamic asked us in digital email if "we would agree to terms" that we were not owed a refund and 'go our separate ways without payment due to either party." I have also attached the email for proof of records.

      "Jennifer, 

      We are in receipt of the shipping labels for Ms. *****'s materials.  Unfortunately, I cannot ship the materials until we have addressed storage fees and associated labor charges that must be addressed before materials leave the DBS facility pursuant to the terms and conditions of the project.  Previously I had offered to waive any such fees if both parties agree to go their separate ways without payments due to either party, does Ms. ***** agree to those terms? Please advise.

      Given the nature of how this company does business I would not want to work with them anytime in the future and have made it clear that I would not accept any outcome except for a full refund based on failure to complete within a reasonable time frame, business losses, lack of communication, lack of final produced fragranced product.
