On July 5, 2022, Wasatch Railroad Contractors’ owner, John Eldon Rimmasch, was sentenced to 30 months in prison and 3 years of supervised release.
Rimmasch was also ordered to pay restitution in the amount of $7,428 and a special assessment of $600. Wasatch Railroad Contractors was ordered to pay a special assessment of $2,400.00.
This sentence came after Wasatch and Rimmasch were found guilty by a federal jury on five counts of wire fraud and one count of knowing endangerment.
These convictions stem from a contract entered into with the National Park Service (NPS) to restore a historic railcar. Wasatch failed to complete the restoration, and in the process, endangered its employees by exposing them to asbestos without proper safety measures.
Despite failing to properly perform asbestos abatement, Rimmasch certified that it had been completed and invoiced NPS in full.
Furthermore, Wasatch failed to pay Davis-Bacon wages to its employees per the contract with NPS. Despite failing to pay these wages, Wasatch, under the orders of Rimmasch, submitted falsified payrolls to NPS.
