On July 13, 2020, Ohio Attorney General Dave Yost, filed a lawsuit against Express Scripts for multiple contract breaches that helped Express Scripts pocket millions of dollars in overcharges to the state.
The suit, filed on behalf of the Ohio Highway Patrol Retirement System, seeks to recover unspecified damages from Express Scripts, which had been the Pharmacy Benefits Manager for the HPRS' health plan since 2010.
The lawsuit filed maintains that, in each year of Express Scripts' contract with HPRS except 2011-12, Express Scripts failed to satisfy the pricing guarantees in the then-applicable pricing schedule, thereby overcharging HPRS on thousands of claims.

Better Business Bureau is advising consumers to use caution when considering doing business with Express Scripts. BBB has received a pattern of consumer complaints alleging delays or failure to ship correct prescriptions or medications; failure to accept returns or medications which were shipped in error; failure to issue refunds; debiting credit or debit cards for prescriptions not shipped and poor customer service.

Express Scripts along with other manufacturers produce 90% of the global insulin supply and the three PBMs administer pharmacy benefits for roughly 80% of prescription claims managed. Insulin has become too expensive for patients whom are uninsured or underinsured causing severe consequences on the lives of the individuals affected.
The lawsuit seeks to control the skyrocketing cost of insulin by promoting price competition for insulin and eliminating unlawful, unfair, and deceptive practices. In addition, it seeks to recover restitution on behalf of California residents for past overpayments for the drug.
